MESSAGE FROM THE PRESIDENT | Tuesday, September 6, 2011, our lawmakers made their way back to our nation's Capitol as Congress was scheduled to reconvene after a brief recess. On the agenda, no doubt, will be jobs, spending, and the nation's deficit. Of course, if most of us were asked, we'd tell them [our lawmakers] if they stopped spending more money than what is brought in, it might help with the deficit problem. But, that's an issue to take up at the voting booth.
NCISS has its own agenda this coming weekend and into next week. As many of you read this message, NCISS members and guests from all different areas of the United States will be on their way to Washington DC, as well, for its most important event of the year, the NCISS Hit the Hill campaign.

Two additional data breach bills were introduced just before Congress left on its recess. S 1434, by Senator Tom Carper (D-DE), the "Data Security Act" and S 1408, by Senator Dianne Feinstein (D-CA). Neither bill includes the pretexting language.

S 799 "Commercial Privacy Bill of Rights Act" by Senator John Kerry (D-MA) would restrict collection of personal data and require consent in some instances.

HR 1528, the "Consumer Privacy Protection Act" by Representative Cliff Stearns (R-FL) also deals with data collection.

HR 978, the "Seniors Identity Protection Act" would ban Social Security numbers on Medicare and other federal identification documents.

HR 1509, the "Medicare Identity Theft Prevention Act of 2011" removes the SSN from Medicare cards. |
HR 321, the "Equal Employment for All Act" denies employers access to credit information. |
HR 822, the "National Right to Carry Reciprocity Act" establishes a national right to carry weapons. |
S 3806, "Secure Facilities Act" requires additional training for private guards employed by the Federal Protective Service" |
S 1199, "Protecting the Privacy of Social Security Numbers Act," by Senator Dianne Feinstein (R-CA) restricts the sale of Social Security numbers but does include an exception for "business to business" transactions. |
S 1151 "Personal Data Privacy and Security Act" by Senator Pat Leahy (D-VT), Chair of the Judiciary Committee requires reporting of data breaches and protection of personal information. |
HR 2168/S 1212 Geolocational Privacy and Surveillance Act. Effectively bans the use of GPS tracking and certain other tracking devices. |
WHO YOU HIRE WILL MAKE OR BREAK YOUR COMPANY By Michael Julian, CPI, PPS Mis-hires cost large companies billions of dollars every year and put smaller operations out of business. With issues like fraudulent Workers' Compensation claims, sexual harassment, discrimination, hostile work environments, employee theft and negligence, who you hire to represent your company isn't just about how great your success can be, but also how great your liability is. If an employee makes a career out of milking the system with fraudulent or exaggerated Work Comp claims you not only lose the benefit of having someone you trained for that position doing the work you need them to do, your insurance rates go up causing higher premiums each year. When employees with a criminal record start moving inventory out the back door, you lose money. When you have to hire an attorney to defend you in a lawsuit for harassment, discrimination or a hostile work environment created by someone you hired, your company and bottom line suffers. All of these issues can be avoided with some simple, basic investigating by someone that knows what to look for. It is absolutely imperative in this day and age to know who you are hiring and what they are capable of.
