"If you build it, he will come." Sound familiar. You remember. It's the voice from the cornfield that actor Kevin Costner hears in his 1989 movie Field of Dreams. That famous line pops in my head when I think of Ben Harroll and his contributions to the investigative profession.
When Ben Harroll opened his private investigative agency in 1978 and began decorating his San Diego office with pieces of PI artifacts, he first thought about the idea of a P.I. museum. Ben believes wholeheartedly in preserving the rich history of private investigators. BILL BUTCHER

Born in St. Joseph, Missouri or "Missoura" as spoken by those in the know, Bill spent most of his formative years in a suburb of Detroit. He attended Michigan's Albion College, graduating with a Batchelor of Arts in Economics, followed by post-graduate work at American University in Washington, DC. Bill joined the Navy and attended Officer Candidate School in Newport, RI. He was assigned to a destroyer escort operating in the Caribbean. During the Cuban missile crisis in the fall of '62, Bill was on that same destroyer escort protecting the United States shores, and then patrolling the North Sea between Iceland and the Faroe Islands.
Bill met his wife, Dina, when he was stationed on the Chesapeake Bay in Northern Virginia. WHAT IS A DAUBERT? |
Daubert v. Merrell Dow Pharmaceuticals, 509 U.S. 579 (1993), applies to all forensic evidence, civil and criminal; i.e., in regards to the theory, technique, and practice:
- Has it been tested and accepted within its community;
- Is it repeatable and are the results consistent as to specific evidence;
- Are the theories and or techniques accepted within its community;
- Does it have peer review and can it be researched;
- Are there known potential errors;
- Are there operational standards for the techniques, and;
- Can the expert present the theory, technique, and conclusions in nonscientific terms and testimony?

ARIZONA
We've had quite a bit of unlicensed activity in AZ by individuals and unfortunately law enforcement. Unfortunately, some law enforcement officers were using their badges and indicating they were better than the average PI because they were cops. We already have a statute on the books re unlicensed activity; but now we have a statute preventing cops from being PIs while employed with law enforcement. All law enforcement must now turn in their PI cards.

California Unlicensed Activity Enforcement
California's regulatory agency, the Bureau of Security and Investigative Services [BSIS], is moving forward with a Rule Making Package that will allow the issuance of unlicensed activity citations and fines. The regulations would permit the BSIS the ability to issue citations/fines to persons advertising in any written, printed or verbal communication for the purpose of soliciting business without a license.
A hearing for public comment will be held at 9:30 am on July 21, at the Department of Consumer Affairs, 1625 N. Market Boulevard, Hearing Room, First Floor, Sacramento, CA 95834. The public comment deadline is 5:00 pm on July 21.

NEW HAMPSHIRE
New Hampshire has seen the first PI Advisory Board appointed by Governor John Lynch. This Board is a by-product of the new legislation that made strides in the Private Investigator's licensing in the State. NH League of Investigators were instrumental in the passage of this legislation which took several years to pass. The NH league of Investigators is please to announce that it's President, Quentin Estey and Sheldon Nason were two of the three PI's appointed. The NHLI is looking forward to this Board to professionalize the profession within the State and strengthen the licensing laws.

� S 21 "Cyber Security and American Cyber Competitiveness Act of 2011''-sponsored by Senate Majority Leader Harry Reid (D-NV), it calls on Congress to act on cybersecurity and data breach legislation.
� HR1701/HR 1841 "Data Accountability and Trust Act"-these data breach bills include language which may restrict the use of pretexting in some instances.
� S 799 "Commercial Privacy Bill of Rights Act" by Senator John Kerry (D-MA) would restrict collection of personal data and require consent in some instances.
� HR 611, the "Best Practices Act", Representative Bobby Rush (D-IL). This data collection bill is similar to S 799.
� HR 1528, the "Consumer Privacy Protection Act" by Representative Cliff Stearns (R-FL) also deals with data collection.
� HR 978, the "Seniors Identity Protection Act" would ban Social Security numbers on Medicare and other federal identification documents.
� HR 1509, the "Medicare Identity Theft Prevention Act of 2011" removes the SSN from Medicare cards.
� HR 321, the "Equal Employment for All Act" denies employers access to credit information |

VOLUNTARY LICENSING
BILL SIGNED!
In the afternoon of Friday, June 10, 2011, the Professional Private Investigators Association of Colorado received an email from Colorado Senator and bill sponsor Linda Newell. June 10th was the last day for Governor John Hickenlooper to make a decision on several bills. HB11-1195 was in the mix with those bills. The Governor could sign the bill, veto it, or not sign it. If it was not signed, it would still become law. In the final tense hours of the business day, HB1195 was FINALLY signed into law!!!! PPIAC, and all Colorado investigators for that matter who have long desired to obtain a license can breathe a big sigh of relief.
The Professional Private Investigators Association of Colorado has been involved in over 30 years of efforts to restore licensing, only to face defeat after defeat. HB 11-1195 specifically has been at least a 1 1/2 year long effort. Decades...read more_
