Lodging Industry Targeted by Department of Labor
The American Hotel & Lodging Association learned in June that the U.S. Department of Labor's Wage and Hour division is in the final planning stages of an enforcement initiative that targets the lodging industry in general and hoteliers that employ H-2B workers in particular. It is highly likely that every other hotel in the country could be subject to an audit as well.
The Wage and Hour Division is targeting industries where it fells wage and hour violations "are most likely to occur" and to ensure that those workers they feel are "most vulnerable" are not being exploited. The Wage and Hour Division has stated that it will "pursue corporate-wide compliance strategies to ensure that employers take responsibility for their compliance behavior" and that it will "use penalties, sanctions, the Fair Labor Standards Act hot goods provision, and similar strategies - as appropriate - to ensure future compliance among violators and to deter violations among other employers."
The lodging industry will be subject to these actions on two fronts:
1. The Wage and Hour Division has labeled hotels as a so-called "high-risk industry" that employs the most vulnerable workers. Our industry will be one among a few others that will be targeted. The Wage and Hour Division will begin to aggressively audit lodging properties for wage violations and violations of other things under their jurisdiction and;
2. The "Hotel and Motel Resort Pilot Initiative" will specifically target lodging properties the employ H-2B workers. This appears to be driven by the philosophy that foreign workers are unnecessary and part of a larger strategy to choke the H-2B program off completely through regulations and administrative actions. The Wage and Hour Division will most likely focus on seeking violations of labor certifications as well as violations of other rules (see #1 above).
You should consult with your labor attorneys in order to prepare for a wage and hour audit. You should perform a self-audit now to ensure you are in compliance before you are notified of a wage and hour audit.
Hoteliers should also contact their members of Congress and letting them know that these actions by the Department of Labor are not justified and that they need to contact the department on your behalf to insist that they be stopped. |

FY2011 Federal Per Diems Announced - Conus Lodging Rate Increased
The U.S. General Services Administration (GSA) today announced the new Fiscal Year 2011 (FY2011) federal per diem rates, which take effect October 1, 2010, and run through September 30, 2011.
The standard Continental United States (CONUS) per diem rate for lodging applies to destinations that are not listed as specific destinations. That rate, which is reviewed every three years, increased to $77 per night. GSA noted that with the increase in the standard CONUS lodging rate, several areas that had previously been non-standard areas obtained the standard CONUS rate of $77 for lodging in FY2011. The last adjustment to the standard CONUS rate was made in fiscal year 2008, establishing the nightly lodging rate at $70, which has been in effect since 2005.
Despite the increase in the standard CONUS rate, GSA noted that its data on average daily rate (ADR) for hotel rooms clearly indicates the deep negative impact the economic downturn has taken on the lodging industry, showing a 5.73% decrease of the estimated lodging costs as compared to FY2010. In contrast, FY2010 had a slight increase of 0.6% over the previous year, while FY2007-09 had an estimated average increase in lodging costs of 6.8%.
GSA establishes federal per diem rates by using market data provided by Smith Travel Research in order to establish rates that reflect the market where those rates apply. Although federal per diem rates cannot formally be appealed by business representatives, GSA does have the ability to review and modify the rates.
AH&LA is advising members who believe their localities may be undervalued in the FY2011 per diem rate schedule with a number of helpful suggestions that can be found within this past AH&LA Advisory.

An issue that used to be relegated to sweepsweeks coverage has now officially become one of the summer's biggest stories - bed bugs. Compounding the increased coverage are the surveys being conducted by various pest control companies to drum up business. Fortunately the incidents being reported on are largely centered on retail stores, movie theaters, and even the Empire State Building, and not hotels.
AH&LA has been aggressively engaging the media. AH&LA President/CEO Joe McInerney has been interviewed extensively for print, radio, and television, including Time Magazine, NPR's Diane Rehm Show and DC's Fox and NBC affiliates.
What You Can Do Create a formal policy on how to handle a bedbug outbreak or complaints.
To effectively treat a one-bedroom space, pest elimination companies estimates range from $800 to $1,200. The best prevention is daily inspection. Employees should inspect rooms for bed bug activity every day by inspecting: - guestroom linens;
- mattress and boxspring seams;
- headboards;
- bedding;
Staff should be looking not only for live insects, but also for cast skins or speckles of dried blood or excrement on furniture or in places where bed bugs hide. Pay close attention to cleaning guestrooms by vacuuming rooms and accessories daily; inspecting incoming furniture and wall hangings that may have been stored or warehoused; and inspecting and repair loose wallpaper and cracks in baseboards to reduce areas where bed bugs can settle. AHLEI has released a 12-minute DVD, Bed Bugs: Facts & Prevention, to meet the training needs of housekeepers, maintenance employees, and property managers. The program raises awareness of this critical issue and provides information to help employees, detect, manage, and prevent bed bug infestations. The National Pest Management Association's bed bug hub also has a host of resources to assist in your efforts, including the popular bed bug posters.

Hotel "Call Arounds" Ruled Illegal
In early April, the La Quinta hotel chain formally agreed to nationally cease "call-arounds" after Connecticut Attorney General's antitrust investigation found that the call-around practice is prevalent in the hotel industry. The potentially anti-competitive practice occurs when competing hotels exchange current room rates and occupancy information that can be used to fix prices.
Since that time, several other hotel chains around the US have advised their franchise owners to also cease call arounds as they are seen as potentially fixing prices. They are also advising their franchise owners who conduct call arounds to seek legal guidance as price fixing is a violation of the federal Sherman anti-trust laws.

The Alaska Hotel & Lodging Association is partnering again with WageWatch, Inc., the leading web-based compensation and benefits survey company in the nation, to conduct a statewide survey of the lodging industry in Alaska. When complete, this survey will tabulate data for 37 key management, salaried, and hourly positions within our industry. Results will be broken down at the state level, as well as city level for all areas where five or more properties submit data. Which means the more that participate the more detailed the information we be. We encourage all of you to submit data and encourage your fellow hoteliers to do the same.
The survey will be sent out to everyone in the next few weeks. Please keep an eye out for the survey.

Hurricanes and other natural disasters
Unlike last year, the 2010 hurricane season (June 1-November 31) is forecasted to be "active to extremely active" according to the National Oceanic Atmospheric Administration (NOAA). The AH&LA Information Center receives scores of requests for emergency plans and checklists every year. The following are two of the most popular resources available to your members for hurricanes and other disasters: AH&LA's Emergency Planning and Preparedness Web pages are loaded with resources and helpful information regarding the BP oil spill, flood planning, hurricanes, and more. Pinellas County, Florida's eight-page " Sample Hotel/Motel Hurricane Plan" is a turn-key document which can be modified to suit the needs of individual properties. The plan even includes a post-hurricane "Getting Back in Business" checklist. "Strengthening lodging demand lifts pricing expectations." This promising headline is from Pricewaterhouse Coopers' May 2010 Hospitality Directions US report. The 27-page forecast report is available for free download by filling out a request here. Social Media Policies for Employees Off the Job Q: We are concerned about the use of social media sites by our employees in their off time. As a company are we able to set employee policies for the use of Facebook, Twitter, and the like? Do you have some guidelines for crafting a policy? A: Yes, and yes. Employers can, and are encouraged to, develop policies regarding the online communications of their employees. An August 2009 survey of over 800 companies by the Society of Corporate Compliance and Ethics revealed that 50% did not have a policy for employee online activity outside of work. Of those companies that do, 34% include it in a general policy on online usage, and just 10% specifically have a policy addressing the use of social networks. In the hospitality industry, the Domino's Pizza incident and the public relations fiasco that ensued, is legendary. (For those unfamiliar with the damage to Domino's brand by two employees posting a YouTube video, you can read about it here.) It's not just the rants of disgruntled employees that companies should be concerned about, but the inadvertent sharing of company secrets and strategies online is also a concern. Facebook status updates ("going to Miami to check on a possible site for a new property") and Twitter tweets can spread like "an infectious disease." | Education | New Education Committee
We are excited to announce the creation of a new committee for AkH&LA, the AkH&LA Education Committee. This group will be responsible for dedicating the education donations members pay on their annual dues invoices between post secondary and current workforce education, trainings, scholarships and more. In addition, the committee will identify other fundraising opportunities to maximize the amount of funds we are able to give back to the industry.
Currently the committee is working on a scholarship application for Professional Development (see below). We'll also be announcing industry scholarships for post secondary education for employees and family members of employees in the hospitality industry. Keep an eye out in the next few newsletters for more information.
