KAR BOD: Action Items

 

KAR just completed its Summer Business Meeting at Lake Barkley where members came together to conduct business, learn about real estate issues and enjoy the beautiful weather. Below are some of the action items along with some useful information that was shared during the committee meetings:
  
 - As part of the strategic plan, to put funds in the 2012 budget for the production of a member benefit video, to link to vendors from the KAR Convention on the website and to revisit the community service program in 2013.
  
- To provide an additional $6,000 in 2011 to the professional legal fees budget line item to file an amicus curiae brief, if needed, in the case of Waldridge v. Home Services of Kentucky, Inc.
  
- Approved of the application of Arvel J. (Jerry) McMahan, president of McMahan, Co, Inc. and Principal Broker of Coldwell Banker McMahan Company, in the amount of $50,000 from the Legal Action Fund and requests copies of invoices paid by Mr. Jerry McMahan for expenses related to Case 3-05-cv-612-R - Casey William Hyland and Graham Pullen (Plantiffs) vs. HomeServices of America, Inc., HomeServices of Kentucky, Inc., Semonin REALTORS, Rector-Hayden REALTORS, Re/Max, Century 21 Real Estate Corp., Coldwell Banker Real Estate Corporation, and Coldwell Banker McMahan Company.
  
- In the event that NAR approves the following in November, KAR will require REALTORS� to mediate otherwise arbitrable disputes from the local boards/associations that utilize KAR's services. The local boards/associations that resolve disputes themselves have discretionary authority on how to handle disputes.
  
- The 2012 Mediation Training will be held in Lexington with Tony Belak as the trainer. Dates are still to be determined.
  
- The 2012 Professional Standards Training will be held in Lexington, Louisville and Madisonville in February. Dates and trainer are still to be determined.
  
- KAR will review the existing law on the liability of a licensee when performing CMAs and BPOs.
  
- Support the following changes to the KY Condo Act: 1) the resale certificate should be mandatory, 2) the act should apply to all condos (keeping the existing exceptions in place), 3) there should be a cap on the fee for the resale certificate and statements of unpaid assessments.
  
- To allocate up to $150,000 from the Issues Mobilization Fund to being the development and implementation of an issues campaign for Sales Tax on Services.
  
In addition:

The Legal Affairs Committee will continue to gather information regarding the Legal Hotline Service for KAR members. Requests for proposals will be solicited and evaluated with a recommendation to be presented to the BOD at the September meeting.
  
Updates on MARS and the Lead Renovation, Repair and Painting Rule (RRP) were presented by Harry Borders, an attorney from Louisville. To find out more about these issues, click the links above to download and view the presentation from the meeting.

2011 KREC nominations

 

Any real estate licensee wishing to be considered for a 4-year term as a Kentucky Real Estate Commissioner should contact KAR. An application and detailed requirements are available at www.kar.com and by mail. To qualify, one must have been a resident of Kentucky for 10 years and have held a Kentucky real estate license for 10 years. Deadline for submission is August 5, 2011 to KAR, 161 Prosperous Place, Suite 100, Lexington, KY 40509. Questions may be directed to [email protected] or call 800.264.2185.

Positions open: President-elect, Treasurer-elect, At-large Director (3), At-large Delegate (3), Region Director (for Regions 1,3,5) and NAR Director.

To apply for any of the available positions, fill out an application and submit to KAR. Qualifications and descriptions of each of the positions and complete instructions is included in the application packet. Elections will be held in September at the KAR Annual Convention & Expo in Lexington.
