| Correction - "Classing Out" Employees |
| In our last broker connection, Coventry Health Care communicated a position on Section 2716 ("Prohibition of Discrimination Based on Salary") of the Patient Protection and Affordable Care Act (PPACA) that indicated we would prohibit subgroups with different eligibility rules for non-Grandfathered employers. This is an incorrect statement of our position. Coventry Health Care maintains the position that employers retain ultimate responsibility for decisions related to eligibility. At the time of sale or renewal, Coventry Health Care will establish and maintain subgroups as directed in writing by the employer. As always, we encourage our clients to obtain independent legal advice to ensure compliance with all aspects of state and federal laws governing eligibility for group health insurance. |
