We need your help!!! 

The construction workers in this photo are a little too clean, don't you think?  We have a great opportunity to put them back to work but we need your help!

 

Congress is considering several mandatory E-Verify bills that will get the estimated 8 million illegal workers out of our jobs and help some 20 million unemployed Americans return to work. 

 

The problem is that the Chamber of Commerce (plus organizations representing Builders and Restaurant workers) has gotten their hands on the bill with the most momentum--Rep. Lamar Smith's bill.  We need to fix that.  We don't have the money that these organizations have.  We only have People Power.  Unfortunately, we have to convince our usual allies--FAIR and Numbers USA--to withdraw their support for the Smith bill until and unless it is fixed.

 

  

We are winning!

Believe it!  We're winning!  If we weren't, the Chamber of Commerce, et al, would not be trying to co-opt Smith's
E-Verify bill.  jumping for joy

 

We just won a huge victory against the Chamber in the Supreme Court case of the Chamber v. Whiting.   In this case, the Chamber attempted to stop Arizona from mandating E-Verify and from revoking the business licenses of employers caught hiring illegals.  The Chamber lost. As a result, the list of states passing their own immigration enforcement bills is growing by leaps and bounds!  Just yesterday, Louisiana Governor Jindal signed an E-Verify bill into law.  There is nothing the Chamber fears more than state enforcement.  They know the Feds cannot effectively enforce immigration laws without state help.

 

In one last attempt to stop state enforcement of immigration laws, the Chamber is supporting the Smith E-Verify bill. Why in the world would they do that? Because the bill includes confusing and poorly-worded language that would preempt state laws and effectively tie the states' hands. For example, although Sheriff Joe has 287(g) training which authorizes him to help enforce immigration laws, Smith's bill would stop this. It would also erase most of the laws passed by states like Indiana. The Smith bill would allow states to revoke business licenses for E-Verify violations BUT ONLY after the Feds successfully prosecute those employers. Since the Chamber of Commerce believes, and with good reason, that the Feds will not prosecute employers very often, the states will rarely revoke a business license AND will basically be removed from the playing field when it comes to enforcing immigration laws. Are you beginning to see why the Chamber signed on to this bill? Do you see why FAIR and Numbers USA should withdraw their support for Smith's bill?

     

 

Deja vu all over again? 

I am not the only one who feels this way. Tom Tancredo initially supported the bill. He withdrew his support aftter taking a closer look. He now compares the Smith bill to Lucy jerking the football away from Charlie Brown.   

 

Kris Kobach who helped write many of the state laws also opposes the Smith bill. Mike Cutler, the retired INS agent who testified in support of Indiana's SB590, says the bill is "Deja vu all over again!" Meaning that it is like the 1986 legislation that sounded tough but was never enforced. 
The 1986 law resulted in the first Amnesty of nearly 3 million illegal aliens. Arizona state senator Russell Pearce opposes Smith's bill. So, does Congressman and former Hazelton, PA mayor Lou Barletta.

"While there are lots of good things in Chairman Smith's mandatory E-Verify bill, I cannot support it until the state preemption and Ag worker amnesty portions are removed.  Tom Tancredo has withdrawn his support for this bill.  I hope you will also withdraw your sponsorship of this bill until it is fixed."
