New Tax Breaks for Employers!
Employers may be eligible for two new tax breaks and not be aware of it. The Hiring Incentives to Restore Employment Act (the HIRE Act) became law on March 18, 2010. This legislation was passed with little fanfare in attempts to boost hiring. The new tax benefits are available to employers who hire certain previously unemployed workers ("qualified employees").
Qualified new employees are full-time or part-time workers who start work between 2/4/10 and 12/31/10 and who were not employed more than 40 hours during the 60-day period ending on their start dates. However, the new worker cannot replace another worker unless that person quit voluntarily or was discharged for cause.
Qualified employers include private-sector businesses, tax-exempt not-for-profits, and eligible public higher-education institutions. The first tax benefit, referred to as the payroll tax exemption, provides employers with an exemption from the employer's 6.2 percent share of social security tax on wages paid to qualifying employees, effective for wages paid from March 19, 2010 through December 31, 2010.
In addition, for each qualified employee retained for at least 52 consecutive weeks, businesses will also be eligible for a general business tax credit, referred to as the new hire retention credit, of 6.2 percent of wages paid to the qualified employee over the 52 week period, up to a maximum credit of $1,000. There are some additional requirements for the credit.
More information can be obtained at the Internal Revenue Service's website: www.irs.gov. Search for HIRE Act 2010.
