Happy New Year
We wish all of our members a very happy new year and hope you have enjoyed a relaxing holiday break. You will have no doubt returned to your office refreshed and recharged to get stuck in to your busy role again. But are you planning to do a few things differently? We asked some of our CLANZ friends what their new year's resolutions are for 2011.
Our valued patron Sir Ian Barker says "I shall try this year to make a start on writing a series of vignettes about life in the law as I have observed it over the last 50 years. This is not an autobiography but hopefully will be a record of how things have changed in our profession over the course of my three careers. (i.e. barrister, judge and arbitrator").
NZLS President Jonathan Temm says "This year will see me keeping a work/life balance as a priority. I am back on my road bike and will ride the 100k flyer from Rotorua to Taupo again this year. I am also up for three other long cycle events. My life at the moment is endless meetings and muffins and so I need to do some physical exercise to make me feel alive!"
CLANZ President Jeremy Valentine says "I have resolved to make the most of life in 2011, through giving quality time to my family, friends, work and hobbies (the "me" bit) and finding the right balance. For the "me" bit, that involves taking up cycling and playing more golf in 2011 than I did in 2010 - without undermining the achievement of the balance goal!"
A few of our committee had long ago resolved never to make new year's resolutions and one or two who wish to remain nameless are still working on kicking their "social" smoking habit. One great response was "I resolve to work with neglected children - my own".
Whether you have made your own resolution or if you are just trying to keep the wheels turning, one of our favourite books to remind us how to put our resolutions into action and to prioritise and be truly effective is the well loved "Seven Habits of Highly Successful People" by Stephen Covey. If you haven't made a resolution this year, you might want to resolve to pick up this book next time you are at the library or bookstore. Best wishes

Conference News
Registration is now live for the 2011 CLANZ conference and registrations are already flowing in. We are delighted to have confirmed Justine Troy as our opening keynote speaker. Those of you who enjoyed John Allen's provocative opening presentation last year heard him challenging the myth that New Zealand is a dynamic little country punching above its weight. In his view, we are insignificant on the global stage and are not sufficiently innovative or entrepreneurial.
Justine Troy, together with her partner Geoff Ross, created the global brand 42 Below Vodka and she provides a concrete example of the sort of spirit John was encouraging. Her new book 'Every Bastard Says No' is the irreverent story of how Justine, Geoff and their team risked all and worked their butts off to do what New Zealanders dream of doing but so rarely manage: build a brand that makes the world sit up and take notice. Justine is a straight talker and her views are sobering for Kiwis as she believes many of us are happy to celebrate and rejoice in our success and (imagined) global dominance but we might not get behind our struggling entrepreneurs until then. She definitely provides food for thought.

Farewell to Des Ryan
We are sad to report that one of our long time members Des Ryan died on 4 January 2011 after battling a long illness. Des was a senior solicitor at the Department of Building and Housing for six years and was previously with Parliamentary Library and the Ministry of Justice.
Des was nominated last year for the CLANZ-LexisNexis Corporate Lawyer of the Year and part of his nomination reads; "I think Des' clients see him as a member of their team, who just sits with mine. Clients are constantly at his desk, sometimes with legal questions, sometimes with questions that simply need a wise head and sound judgement to offer a steer. But even with the right technical skills and the trust of your clients, you still need to be part of a wider legal team. Here Des excels. Without exception he is ready to take on the extra task, to work late when the pressure comes on, to take the load off others and to lead with his exemplary professionalism and endless good humour".

The Community of CLANZ
In surfing through our ever-growing membership list, it is interesting to reflect on where CLANZ members are based in New Zealand and throughout the world. Far from the old view that New Zealand in-house lawyers were only based in Auckland and Wellington with a handful in Christchurch, we have growing numbers of members in other parts of New Zealand and around the globe.

Expert Evidence
The Legal Research Foundation is hosting a one day conference entitled "Expert Evidence in New Zealand" in Auckland on Friday 18 March. CLANZ Patron Sir Ian Barker is chairing the conference and speakers include Hon Justice Asher, Hon Justice Winklemann, Hon Justice Ray Finkelstein, Jim Farmer QC, Robert Fisher QC and John Billington QC.

Carbon Forestry
The Forest Industry Engineering Association is holding a two day conference in Auckland on 13 and 14 July 2011 called Carbon Forestry 2011. Further information is available on the event website www.carbonforestryevents.com.
Carbon Forestry 2011 is the first conference run in New Zealand focused on carbon forestry, carbon trading opportunities and the Emission Trading Scheme. Cloud Computing
One of the big issues facing IT managers today is whether to utilise the benefits of cloud computing. Simply put, cloud computing is the storage of data and the use of software applications that are hosted by a third party at a remote location. These remote servers can be located domestically, or possibly in Europe or the United States. As access to your data is over the internet the physical location of the servers isn't a huge issue. The primary benefit of cloud computing is the ability for a business to hire space on a third party's hardware, instead of the expense of having to purchase and maintain their own hardware systems.
The economic benefits of this arrangement are easy to understand but a major issue with the cloud is that essential business operations and data is now located on a third party's hardware. Apart from the normal issues of access and reliability, there are the legal questions of discovery, privacy, protection of confidential information and responsibilities for compliance.
