Pro-Link GLOBAL Corporate Immigration GLOBAL Brief

POLAND | "Bridging" Visas No Longer Issued

Effective 28 December 2010, the Polish immigration authorities will no longer issue temporary "bridging " visas.  Previously, these were issued to non-European Union national applicants undergoing a residence permit renewal process whose initial permits expired before the renewal process was completed (but who had submitted correct renewal applications prior to the expiry of the initial permits).   Under the new rules, such applicants will still be permitted to reside in Poland during the renewal process, but instead of receiving a temporary visa, will have their passports stamped as a record of the renewal application.

Impact on Foreign Nationals in Poland

It is likely that the stamp, unlike a visa, will not be accepted by other Schengen member states as evidence of the right to travel throughout the Schengen area.  Applicants requiring visas to enter the Schengen area will likely need to wait until the renewed residence cards are received before travelling to Schengen member states.  It may be possible for such applicants to obtain additional Schengen visas to allow travel; Pro-Link GLOBAL will advise on a case by case basis.

ACTION ITEMS FOR EMPLOYERS
  • Note that temporary "bridging" visas will no longer be issued; it is more important than ever to submit renewal applications in good time.  Please give Pro-Link GLOBAL at least three months' notice for all Polish non-EU renewal applications.
