NETHERLANDS | Modern Migration Policy Delayed

 

 

The Dutch immigration authority (Immigratie end Naturalisatiedienst, or "IND") has announced that the implementation of its new procedures - the modern Migration Policy - will be delayed and will not be launched in January 2011 as originally planned.

What is the Modern Migration Policy?

 

We first mentioned this new policy on our blog, Caveat Lector.  We also issued a Global Brief on the same subject in October this year (available here) , which discussed the Modern Migration Policy in more detail. 

In summary, the Modern Migration Policy, when implemented, will substantially shift responsibility for immigration compliance to the employer and to the employer's legal representatives.  Employers, who can become registered sponsors and thereby benefit from an expedited process,  will have a duty to keep records, report changes, conduct fair and transparent recruitment and to repatriate foreign national employees if necessary.

Why the Delay?


The launch of the Modern Migration Procedure has been delayed until further notice due to the ongoing implementation of a new computer system (INDiGO) at the immigration authorities.

What Happens Next?


The immigration authorities will give us three months' advance warning before the modern migration Policy is implemented and we will, of course, keep you informed.
