California's historic water social contract been held together by force, fraud and sometimes the consent of the governed.  The result has been Northern California giving up water to Central Valley farmers and Southern California cities in exchange for Delta flood protection, cheap hydropower and some water for themselves.
 
But due to the combination of the San Joaquin River Restoration Settlement Act of 2009, by Democratic U.S. Sen. Dianne Feinstein, and the California Legislature's new Delta Reform Act, SB X7-1 from 2009, California's historical water social contract is on the verge of cracking up.  There is too much force and fraud and too little consent of the governed.  Read More... 
 
 

In 1994, as Executive Director of the California Watershed Posse Coordinated Resource Management and Planning Council, I whole heartedly supported the 1994 Bay-Delta Accord.  That agreement was hailed by the Clinton Administration as a model for the settlement of long standing competing water interests.  Interior Secretary Bruce Babitt commended that Accord as " a powerful case study"... that could untimately save the Endangered Sepcies Act.  Senator Dianne Feinstein offered strong support for the Bay-Delta Accord and takes credit for facilitating the agreement.  "The Bay-Delta Accord provides a roadmap for meeting the twin objectives of ecosystem restoration and improved water supply."

 

I am extremely concerned with the many  laws and regulations that nullified our God given "Unalienable Rights" of Life, Liberty and the pursuit of Happiness found in the Declaration of Independence.   The state of California and the federal government have replaced our God given rights with an  Administrative State's regulatory culture that already has cost America billions, if not trillions, stifled economic growth and infringed on fundamental personal liberties.  These massive and unaccountable bureaucarcies have taken our property rights, rescinded our senior water rights, as well as removing our right to use our energy generating natural resouces that are secured by the 9th and 14th amendment of our U.S. Constitution.
