Georgia House Speaker Introduces Hawks Rule Change
Tuesday, House Speaker David Ralston introduced House Resolution 1168; a bill that will formally abolish the "Hawks" from the Georgia House of Representatives.
Ralston campaigned on a pledge of killing the Hawks; legislators that served as ex-officio members of every committee who could swoop in and vote as directed by the Speaker. The Hawks were instituted under the Speakership of Glenn Richardson.
H.R.1168 passed the House Rules Committee, and is currently awaiting debate and a vote on the House floor. (It passed unanimously in the house.) |

During last week's budget hearings, state Rep. Jimmy Pruett, R-Eastman, noted that the state spends $36 million a year testing K-12 students, and that $21 million of that is used for tests mandated by the state, not the federal government.
State Schools Superintendent Kathy Cox said her department is looking at changing some of that, but her hand could be forced. State Rep. Stephanie Stuckey Benfield, D-Atlanta, plans to push legislation requiring the state Department of Education to drop Criterion-Referenced Competency Tests for first-graders. Cox has said that would save about $700,000 a year.
Benfield's bill also would require the state to study dropping the tests in second grade.
"Georgia is the only state that has the CRCT in first grade," Benfield said Wednesday. "And we're in the minority on the second grade as well."
Benfield is a Democrat, which typically doesn't help get a bill passed in the Republican-controlled Legislature. But new Speaker of the House David Ralston, R-Blue Ridge, has promised repeatedly to take good ideas from anyone interested in working together. And Benfield's suggestion has at least some bipartisan support.

Temporary child care assistance program targets families affected by recession
The Georgia Department of Human Services (DHS) has created a new federally funded program called Temporary Child Care Assistance (TCCA) that will be operated under the state's Child Care Program. The program, which ends in September 2010, will provide time-limited assistance with child care costs for families that qualify.
To qualify for TCCA, a person must:
Be a Georgia resident
Be actively involved in either job readiness training, vocational training, technical school or college
Be unemployed or work part-time
Have income that falls within the income guidelines
Care for a child who is 12 years old or younger (or 17 years or younger if they have special needs)
To receive TCCA benefits, families must either apply directly online or call 1-866-371-8222 to receive a paper application by mail. |
House of Grace Health Center
The nonprofit House of Grace Free Health Care Services serves adults 18 years and older who are uninsured and with income at or below 200 percent of the federal poverty level. It is open twice a month on first and third Mondays and serves 15 patients per evening with non-emergency primary care including physical exams, screenings for blood pressure, diabetes, prostate cancer, cholesterol and HIV/AIDS and some lab and prescription services.
Diabetics can get help managing their illness and there is also nutrition and weight management, smoking cessation and stress management services.

Recovery Program
A National Alliance on Mental Illness educational program will take place January-March on the 1st, 3rd and 4th Thursdays of January-March. Peer to Peer is an experiential program for people who have a mental illness and want to establish and maintain recovery. It is a series of two hour weekly programs led by mentors who have experience in living with mental illness.

Six Georgia Lawmakers Sign National Letter for Clean Energy Jobs Legislation
The Coalition of Legislators for Energy Action Now (CLEAN), a national bipartisan group of state legislators working closely with the White House to pass federal clean energy jobs legislation, sent a letter to members of the United States Senate today pressing for urgent action on pending clean energy jobs and climate change legislation. The letter, signed by 1,198 state lawmakers from both parties and 49 states, is the clearest indication yet of broad-based, grassroots support for common sense energy reform legislation that will:
Strengthen America's national security by cutting dependence on foreign oil;
Grow jobs and economic opportunity to every state in the nation; and
Protect the environment by major reductions in greenhouse gas emissions.
State Representatives Debbie Buckner, Pat Gardner, Margaret Kaiser, Stephanie Stuckey-Benfield, Brian Thomas and state Senator Nan Orrock all signed the letter that was sent to President Obama as well as congressional leaders from both parties.
CLEAN says their members, including Republicans and Democrats, will continue working in their respective states and on Capitol Hill to urge final passage of strong federal energy reforms that will create jobs, cut emissions, and reduce America's dependence on foreign oil. |

2010 Legislative Session: Week 3

Ethics
A joint meeting of the House and Senate Ethics Committee met on Monday and opened up with a presentation from former House Minority Leader Bob Irvin, Chairman of the Board of Common Cause Georgia. Irvin laid out several specific requests from the General Assembly in the area of ethics reform, including that campaigns be prohibited from moving money from their campaign accounts, and that a $50 limit be placed on lobbyist expenditures. Irvin also urged for a code of conduct for legislators, and then called unmet pledges to reform ethics by Republican lawmakers an "unredeemed campaign pledge." House Ethics Chairman Joe Wilkinson (R - Sandy Springs), responded firmly that Republicans passed major ethics reform in 2005 (the first year of a Republican majority in the House), and that Irvin's characterization was "something I just cannot accept." Irvin was followed by Bill Jordan , past chair of the Georgia Ethics Commission. Jordan outlined the history and current environment of the ethics system in Georgia for the joint committee. Jordan was followed by Robert Highsmith and Doug Chalmers, two attorneys who have been involved with ethics legal reform in Georgia. Due to time constraints, the meeting was adjourned early and Senator Dan Moody (R - Johns Creek) announced that both Chalmers and former Executive Secretary of the Georgia Ethics Commission Rick Thompson would speak at the next meeting.
Transportation
Yesterday, the Georgia Department of Transportation (GDOT) held a special called Board meeting to discuss their previous action asking GDOT employees to move GDOT to a flow-of-funds method of accounting. Board Chairman Bill Kuhlke opened the meeting by describing his concerns with the resolution, stating that it would be tremendously difficult for the Department to make such an accounting change in the middle of the fiscal year. Kuhlke elaborated that it was his feeling that continuing the Board's previous action would jeopardize the interest rates on $300 million in bonds that Governor Sonny Perdue has proposed in his FY2011 budget. Kuhlke then suggested that the Board rescind the original motion (that passed last week), except for the portion asking Attorney General Thurbert Baker for a speedy opinion on the accounting issue. Board member Roy Harrington made the motion suggested by Kuhlke, which was seconded by Board member Robert Brown. During the discussion period, Chief Counsel Sandra Burgess opined that it would be illegal for the Board to take this action at all, citing Title 50 of the O.C.G.A. annotated, which requires all agencies in Georgia's executive branch to operate on uniform accounting principles. After a lengthy discussion over various definitions involved, the Board voted 6-4 to defeat Harrington's motion. Thereafter, Board member David Doss made a motion to amend his original motion to postpone the institution of accrual accounting methods until July 1, contingent on receiving a favorable opinion from the Attorney General's office. Board member Brandon Beach suggested that a favorable opinion also be obtained from the State Accounting Office. The motion passed with only one dissenting vote.
Across town, work continues at the state Capitol on a funding solution for Georgia's strapped transportation infrastructure. Currently, the leadership of the House and Senate are working with Governor Perdue on a piece of legislation to address this issue. The current proposal being floated would add $300 million in bond revenue to be added to the general fund annually for the next 10 years. That money would be subject to appropriations, and the Department would present a list of projects each year to the General Assembly to justify those appropriations. Current intent is for that money to go to completing the Governor's Road Improvement Program (GRIP) and the creation of freight corridors around the state. Additionally, the legislation would set up a statewide SPLOST vote in the boundaries of the 12 Regional Development Councils (RDCs). Each RDC would vote on a specific list of projects within that region. The vote would be held statewide on a specific day in 2012. However, the results of the vote within each RDC would stand alone. This proposal closely mirrors a legislative proposal presented several years ago, and elements of the proposal currently have the support of varied members of the General Assembly and executive branch.
Texting While Driving?
The House Public Safety & Homeland Security Committee met on Wednesday to discuss HB 938 by Rep. Allen Peake (R - Macon) and HB 944 by Rep. Amos Amerson (R - Dahlonega).
Both pieces of legislation ban texting on cell phones while driving. Much of the discussion on these pieces of legislation centered on how law enforcement would be able to know that a driver is texting, how law enforcement could determine the difference between a driver texting or dialing a phone number (since talking on a cell phone would not be banned), and which types of people should be exempt since the legislation would be applicable to using laptops or other electronic devices (such as law enforcement, fire, EMS and utility workers).
Public Safety Committee Chairman Burke Day (R - Tybee Island) placed both pieces of legislation in a subcommittee that will work to iron out major issues with the bills and merge them together.
On a similar note, the Senate passed SB 306, which removes the prohibition of wearing headsets or headphones while driving if used for communication purposes (this would make it clear in law that hands free head devices could be worn while driving).
Telecom Modernization
On Thursday, the Senate Regulated Industries and Utilities Committee met and Chairman David Shafer introduced a committee substitute to HB 168 . According to the chairman, the committee substitute would eliminate antiquated regulations, level the playing field for telecom competitors, and phase out fees on consumers. At issue are regulations, fees and rules that were established decades ago. However, now that competitive forces from newer technologies are in force in Georgia, Chairman Shafer stated the need for regulations to be updated to reflect the new competitive environment. Another major portion of the bill deals with oversight of the Public Service Commission. Recent editorials have been written in the Atlanta Journal-Constitution , and the Georgia Public Policy Foundation released a study in conjunction with the Discovery Institute arguing for movement on this issue to make Georgia competitive with other Southeastern states and encourage investment.
Speaker David Ralston: No New Taxes
This week, Speaker David Ralston (R - Blue Ridge) spoke out about Governor Sonny Perdue's proposed 1.6% tax on hospitals, which Perdue says is needed to fill an increasing gap in Georgia's Medicaid budget. Perdue's budget forecasters have warned that healthcare providers could experience an across-the-board rate cut of up to 16.5% if supplemental funding for Medicaid is not found. Ralston stated that he'd asked House Appropriations Chairman Ben Harbin to find additional cuts in the budget, anticipating that the 1.6% "bed tax" would not be utilized. |

Revive285 Asks: Is there an alternative to I-285 traffic?
We all know that travel conditions on I-285's top end are a serious problem that must be addressed. But how do we fix the problem? Express buses? Light rail? More lanes? Toll lanes? In 2006, the Georgia Department of Transportation and the Georgia Regional Transportation Authority launched revive285 top end, an initiative to develop a transportation solution for the northern I-285 corridor between I-75 and I-85. The project team, with public input, has since developed eight transportation solutions or "alternatives" to address the I-285 top end problems. In November 2009, these alternatives were presented at a series of public information open houses. The project team is now seeking further public input. If you live, work or play on this corridor, this is your opportunity to help determine which of the eight alternatives should move forward, be modified, or be discarded. You can make a difference. Weekly Legislative Update - Week Three
Legislature Gets Off to a Quick Start with Introduced Legislation
It's just 8 legislative days into the 2010 legislative session, but the House has already introduced 337 bills and 119 resolutions.In the Senate, there have been 41 bills and 100 resolutions introduced so far.
GDOT Budget takes BIG hit in Governor's proposed FY 2011 Budget Recommendation
The State of Georgia's economy and its impact on state revenues is nowhere more apparent than within Governor Perdue's FY11 GDOT proposed budget.Next year, due to declining state revenues, stagnate motor fuel tax collections and how GDOT accounts for FHWA construction and planning funds, the governor has asked that total GDOT spending be reduced by almost $100 million in FY11 from existing FY10 expenditures.
As you might expect, some programs were impacted greater than others.Transit, which had been funded as high as $40.7 million in FY09, was requested to be funded at only $24.5 million in FY11, or a drop of 40% from FY09 budget levels and 8% lower than the present FY10 budget.Funding for airport aid will be reduced by 82%, and railways by 93%, in the proposed FY11 budget when compared to just a few years ago.However, expenditures for state highway system maintenance, construction and operations for the FY09-FY11 period were down just 27%, with a FY11 budget request that was only 4% below the present FY10 budget.This is clearly an effort to keep Georgia's state highways ranked as some of the smoothest, safest and well maintained in the nation.
DNR Budget - Elimination of State Funding for Lake Alatoona Preservation Authority and Clean Air Campaign
While most DNR budgets were proposing an average cut of 8% across the board, state funding for a number of programs were recommended for elimination in the Governor's FY11 budget request.State funding for both the Southwest Georgia Railroad Excursion Authority ($212K) and the Lake Alatoona Preservation Authority ($75K) were recommended for elimination.Furthermore, the governor has requested that the legislature eliminate contract funds for Clean Cities ($10K), the Clean Air Campaign ($620K) and environmental monitoring ($100K).While programs like the Clean Air Campaign will continue to operate, they will undoubtedly be significantly impacted by these proposed reductions in FY11 state financial support. However, there are at least a few bright spots in DNR's budget.DNR estimates, and the governor concurs, that in FY11 the percent of hunters who rate their hunting experience as "satisfactory or better" will only drop 2% and occupancy rates at state park cottages will increase by 3%.So at least we have that goin' for us.
Behind the Scene Work Continues on Regional Transportation Funding Mechanism
While no legislative language or legislation has yet to be introduced, a number of policy and procedural issues are being discussed and debated with legislative leadership, GDOT, the governor's staff, the RBC and other groups interested in improving Georgia's and metro Atlanta's transportation systems.
Some, but not all, of the issues being discussed include:

Constitutionality of allowing a regional transportation sales tax levy by statute
-
Modernizing "Congressional Balancing" language to reflect lane miles, population density, etc.

8 year vs. 10 year vs. 12 year regional transportation sales tax levy based on federal funding requirements (primarily a transit funding issue
-
RC's vs. MPO's for transportation funding/planning for federally designated non-attainment counties outside the core Regional Commission
-
Specific "set aside" percentage of revenues within each county levying a regional transportation sales tax
-
State "incentives" for regions who adopt a regional transportation sales tax
Efforts are progressing towards the possibility of legislative language being proposed within the next week or two.

Governor's Office for Children and Families announces Community Strategy Grant RFP and Training Dates

GAIC is pleased to disseminate information on the Governor's Office for Children and Families' (GOCF) Community Strategy Grant Program.
The Governor's Office for Children and Families' has announced the Systems of Care- Community Strategy Grants program (SOC-CSG) to provide up to $100,000 grants to local communities to support their existing or emerging System of Care framework. By developing productive programs that positively impact GOCF's "Educated" result area, strategies, and associated outcome indicators, funded communites will offer prevention, educational, and social service activities, targeted to specific populations of focus, that are designed to improve the living experiences of children, youth and families and to stabilize and strengthen the family and community.

Weatherization Assistance Available
Free weatherization repairs are now available for low income families living in the city of Atlanta and Fulton County through grants from the U.S. Department of Energy. The repairs are made by the Southeast Energy Assistance, a non-profit agency that has been serving Fulton County for 28 years. Repairs include attic, wall and floor insulation, window and door repair, and repair or replacement of faulty gas appliances.

Our Way Cafe: Fund Set Up to Assist
A fund has been established to assist Our Way Cafe with rebuilding its business in Avondale Estates after being heavily damaged by fire Saturday night. Insurance only covers so much loss and the fund will help cover the gap as well as take care after the restaurant's employees while it is closed for repairs. Please make checks payable to "Our Way Cafe Recovery Fund" and put "ATTN: Ms. Ann Berg" in the memo field. Check should be mailed to Decatur First Bank, 1120 Commerce Drive, Decatur, Georgia 30030.
Avondale Estates residents can also drop off checks to Robert Elrod at 80 Lakeshore Drive, who will ensure they get to the bank on your behalf.
Avondale Estates resident Eva-Marie Roswall and owner of Our Way Café has deep roots in Avondale Estates. She is a 1972 graduate of Avondale High School. Back in 1987, she and David Wiley opened a cafe and a Rock n' Roll club at the old Avondale Towne Cinema. She moved Our Way Café to the "Pizza by Candlelight" space at 303 East College Avenue, next to Agnes Scott College, in 1992 with Susan Samford. In May of 2001, she moved into the Twin Oaks Shopping Center where the Deckners had the Bingo Hall. Susan moved to Tennessee in 2005, so Eva-Marie and her new partner, Jody McFerren, spent the next few years transforming the café into the laid-back and eclectic, neighborhood lunch and dinner venue it is today. Eva-Marie needs the community's help now. Let's show her the old Avondale spirit! |

DeKalb Habitat has several parcels of land that are ready to build, the only thing lacking is a sponsor. While sponsors provide funds and volunteers to build houses, they also benefit from being a sponsor. Volunteers come together to work, but they also have fun at the same time. They build community and help make a better life for a low-income family, which makes the larger community stronger.
Sponsorships can be as little as $5,000, or as much as $100,000. The business or congregation gets publicity on the house sign, on our web site, and participates in the First Nail and Dedication ceremonies. The rewards of sponsoring a Habitat house cannot be measured in monetary terms, but the benefits will last long after the keys are turned over to the Family Partner.
