Catlin USA Introduces Three New Environmental Products

Environmental Protective Professional and Pollution Liability Product (EP3)
Owner's Environmental Protective Professional Indemnity and Excess Contractor's Pollution Liability Product (OEP)
Site Pollution Liability (SPL)

ENVIRONMENTAL PROTECTIVE PROFESSIONAL AND POLLUTION LIABILITY PRODUCT (EP3)

For environmental service firms, Catlin USA's Environmental Protective, Professional and Pollution Liability product not only provides professional and pollution liability to environmental firms, but also provides protective coverage and mitigation of loss coverage that only existed for traditional construction/design-build firms.

Coverage Highlights

Practice or project-specific programs available
Mitigation of damages for first-party costs incurred as a result of negligent acts, errors and omissions in remedial design
Pollution loss including emergency expense, and corporate reputation rehabilitation
First-party indemnity (protective) coverage with difference in conditions (DIC) coverage
Contractor's pollution (CPL) coverage including mold, fungus and legionella on occurrence or claims made basis
No self-insured retention for failure to maintain design professional's insurance
Transportation and non-owned disposal sites (NODS) coverage under CPL coverage part
Limits - up to $10 million per claim/project/aggregate
Minimum premium $10,000/minimum deductible $10,000

OWNER'S ENVIRONMENTAL PROTECTIVE PROFESSIONAL INDEMNITY AND EXCESS
CONTRACTOR'S POLLUTION LIABILITY PRODUCT (OEP)

For owner's of environmental remediation projects, Catlin USA's OEP product provides coverage to the Owner in the event that the contracted design professionals' professional liability insurance, as well as the contracted contracting entities' pollution liability insurance, are not adequate or become unavailable for any reason.

Coverage Highlights

Annual or project-specific programs available
Difference in conditions (DIC) responds to losses in the event that the policy is broader than the underlying policy
No self-insured retention for target customer and traditional delivery system
Excess contractor's pollution liability coverage with option to purchase primary coverage for all contracting entities
Minimum insurance requirements (MIR) for underlying prime design professionals and prime contracting entities apply
Claims-made/occurrence pollution coverage
Provides defense of third-party claims against the owner, subject to specified deductible
Limits - up to $10 million per project/aggregate
Minimum premium of $50,000

SITE POLLUTION LIABILITY (SPL)

Catlin's Site Pollution Liability (SPL) policy offers first and third-party liability coverage for bodily injury, property damage and cleanup resulting from unforeseen pollution conditions. An option for first-party indemnity protective coverage is also available in the event remediation is being performed. Catlin will consider a wide range of risks for primary and excess underwriting.

First- and third-party liability for on and off-site sudden, accidental and gradual pollution events
Mold, fungus and legionella coverage
Non-owned disposal site coverage
First- and third-party transportation pollution coverage
Natural resource damages coverage
Primary contractor's pollution liability coverage option

Limits - up to $10 million

$10,000 minimum premium

Policy term - 10 years - pre-existing; 3 years - new

Supplementary coverages with separate limits:

Claims expense for disciplinary proceedings

Litigation expense reimbursement

Subpoena expenses coverage extension

Corporate reputation rehabilitation
