Chartis Introduces Update to PLL Select Policy Form

Chartis Environmental has introduced the first significant update to its Pollution Legal Liability (PLL) Select Policy Form in six years.  The PLL Select may be used with a wide variety of industrial, commercial, and habitational real estate risks.  This updated form provides coverage flexibility by offering a menu of coverage options that can be selected by the insured including on- and off-site clean-up of new and pre-existing pollution conditions as well as coverage for third party claims for bodily injury and property damage resulting from pollution conditions.  In addition, it offers coverage for emergency response costs, third party claims for non-owned locations and also for covered operations.  Below are the coverage highlights including features, benefits and the classes of business ideal for the PLL Select Pollution Liability Policy.

  • Original Coverage Parts:
  • Coverage A - On-Site Clean-Up of Pre-Existing Conditions
  • Coverage B - On-Site Clean-Up of New Conditions
  • Coverage C - Third Party Claims for Off-Site Clean-Up Resulting from Pre-Existing Conditions
  • Coverage D - Third Party Claims for Off-Site Clean-Up Resulting from New Conditions
  • Coverage I - Third Party Claims Resulting from Transported Cargo - the 72-hour at rest restriction has been removed
  • Coverage J - Business Interruption Expense - co-insurance provision has been amended to 90%/10% with a 3-day deductible period
  • Coverage E - Third Party Claims for Bodily Injury and Property Damage (formally Coverages C and F)
  • Coverage F - Emergency Response Costs
  • Coverage G - Third Party Claims for Non-Owned Locations (formerly Coverages G and H) - applies to Non-Owned Locations including Non-Owned Disposal Sites
  • Coverage H - Third Party Claims for Covered Operations - Contractors Pollution Liability coverage for operations performed away from the covered locations
Features 
  • Up to $25 million limit of liability
  • Minimum deductible $10,000 at $1 million limit of liability
  • Minimum premium:  $10,000 at $1 million limit of liability
  • Policy term:  Up to 10 years
  • Continuity date - date that determines what is considered an existing pollution event versus a new pollution event
  • Expanded definitions of:
  • Pollution conditions to include microbial matter, legionella pneumophila, medical waste EMFs, low level radioactive wastes and illicit abandonment of materials
  • Clean-up costs that include voluntary clean-up programs
  • Insured to include members or managers applicable to Insureds that are part of a Limited Liability Corporation (LLC)
  • Other coverage enhancements include:
  • 90-day Notice of Cancellation
  • Automatic extended reporting period - 90-days
  • Fines and penalties exclusion limited to criminal fines, criminal penalties and criminal assessments
  • Intentional non-compliance exclusion exception for 1) Insured's good faith reliance on outside counsel; or 2) the Insured's reasonable response to emergency circumstances to mitigate pollution conditions
  • Underground storage tanks
  • Asbestos and lead (bodily injury claims)
