Chartis Introduces Enhanced EAGLE Form

For years, the Chartis Insurance (Chartis) Environmental and General Liability Exposures (EAGLE) product has been viewed as a Commercial General Liability (CGL) product with a sprinkling of Pollution Legal Liability (PLL) coverage, usually viewed as a "throw-in."   However, with the changing marketplace, forms and establishment of new programs, the PLL coverage under EAGLE can be as broad, if not broader, than stand alone PLL programs provided.  Chartis is responding to these changing needs of the marketplace with an enhanced version of their EAGLE form by enhancing coverages to align with the current ISO General Liability (GL) form, revising definitions and including other coverages.  
 
The enhanced EAGLE Policy Form includes Emergency Response Costs coverage, which is a new coverage and several expanded coverages and definitions including erroneous delivery, the addition of a per project aggregate limit, the addition of legionella to the definition of pollutants, and a worldwide coverage territory to name a few.  Chartis began writing on the enhanced EAGLE form on January 1, 2010.  Below is a list of the coverage highlights including features, benefits and the classes of business ideal for the enhanced EAGLE.

Claims-Made or Occurrence GL and Additional Pollution Legal Liability (PLL)

·         Four Coverage Parts Based on ISO GL:

§  Coverage A - Bodily Injury and Property Damage

§  Coverage B - Personal and Advertising Injury

§  Coverage C - Medical Expense

§  Coverage E - Additional Pollution Liability

Ø  Coverage Part E-1 - Pollution Conditions from Hostile Fire/Building Equipment

Ø  Coverage Part E-2 - Products Pollution and Exposure Liability

Ø  Coverage Part E-3 - Miscellaneous Contractor's Pollution

Ø  Coverage Part E-4 - Pollution Conditions from Transported Cargo

 Claims-Made Pollution Legal Liability:
·         Coverage D-1 - Gradual PLL for designated locations amended to include bodily injury and property damage of employees at non-owned locations other than locations used to handle, store, dispose, process or treat waste  
·         Coverage D-2 a. and b. - Sudden and accidental pollution provided on a Blanket Basis- amended to 10-day discovery/30-day reporting  
·         Coverage D-2 c. - Provides emergency response costs to expenses incurred within 72-hours of commencement of pollution conditions
