Third Party Transactions

IAR is directing those who have questions in regards to questionable practices in real estate transactions, particularly short sale deals where there are intermediaries involved, to call the Chief of Real Estate Prosecutions, Daniel Faermark, at the Illinois Department of Financial and Professional Regulation (IDFPR). Phone 312-793-1238; e-mail daniel.faermark@illinois.gov. The FBI or the Illinois Attorney General's office were also suggested options.

Scams to Be Aware of

The City of Rockford warns its customers that there have been scammers calling its customers posing as a Water Division or Rock River Water Reclamation District employee telling the customer that their bill is delinquent. They ask for credit card payment over the phone. The City states that they sometimes call to check on service but they will never call to ask for payments. If you get one of these water bill scam calls, you should report it to the city's water division, (815)961-3770.

The Association continues to receive calls from its members regarding a Craig's List scam that has been around now for several years. Home listing Information is pulled from various locations and ads are generated on Craig's List directing viewers to call if interested in renting the property. Often times the homeowner receives a call from a potential renter wanting additional information. It is advisable to be pro-active with your clients and advise them in advance, when listing their property, of this potential scam.

Bank of America Changes Policies

Bank of America Home Loans recently changed underwriting standards for the FHA loans it provides through its mortgage loan officers for FHA purchase mortgages. Bank of America will increase its flexibility on FICO score requirements and allow borrowers with minimum FICO scores of 580 to apply for loans, assuming they meet certain debt-to-income requirements. Agents with questions about Bank of America's underwriting criteria for FHA loans should contact a Bank of America Mortgage Loan Officer. (NAR Washington Report)

Bank of America has also changed its short sale process allowing agents to submit a backup offer on a transaction if the original buyer has walked away from the sale. Guidelines for Submitting a Backup Offer
