Delaware

Passed by Senate 21-0, 5/12/11; Introduced in House and Assigned to House Revenue & Finance Committee, 5/26/11:

Senate Bill No. 40: An Act to amend Title 30 of the Delaware Code pertaining to business tax credits and deductions and clean energy technology device manufacturing. The legislation would modernize the scope of Delaware's primary economic development tax incentive program by including provisions specifically designed to attract manufacturers of advanced clean energy technology power generating devices and systems.

New Jersey

POSTPONED:
New Jersey Energy Master Plan Public Hearings: 
The Public Hearings prior to the issuance of the draft revisions to the State's Energy Master Plan by the Board of Public Utilities have been delayed for a second time. The rescheduled hearing dates are July 26 (New Jersey Institute of Technology, Newark); August 3 (State House, Trenton); and August 11 (Stockton College, Pomona). Gov. Christie has tasked the BPU with revisiting the 2008 Energy Master Plan in light of current economic conditions to ensure a balance between increasing challenges in meeting current and future energy needs in New Jersey.

(Passed Senate 6/28/2010):

S-2006 (Substituted for identical Bill A-3125):  Prohibits municipal zoning ordinances from regulating solar panels under certain circumstances; limits fees for certain renewable energy installations.  The Bill, if signed into law by the Governor, will prohibit municipalities from charging excessive fees for processing applications for the installation of solar facilities on residential properties, and also from adopting ordinances that regulate the installation of solar facilities on residential properties when certain dimensional and setback limitations as set forth within the Bill, are met.

Waste Committee as a Substitute, 2nd Reading, 5/19/2011:

This committee substitute amends the definition of "Class I renewable energy" contained in the "Electric Discount and Energy Competition Act," P.L.1999, c.23 (C.48:3-49 et al.) to enable customer-generators using geothermal heat pumps that meet standards set by the Department of Environmental Protection, in consultation with the Board of Public Utilities (NJBPU), to obtain credit for electricity produced by their renewable system.

A-3893: Would establish uniform real property taxation for commercial renewable energy systems and eliminates municipal construction permit fees for non-commercial renewable energy systems.

Introduced and referred to Assembly Telecommunications and Utilities Committee, 5/9/2011; Reported from Committee, 5/19/2011, and referred to Assembly Housing and Local Government Committee:

A-3992:  Would establish a new category of farmland-based wind energy generation projects on certain farms providing that the criteria within the Bill are met.  The Bill would also amend the Municipal Land Use Law to provide that such a project would be deemed a permitted use and application for its development would be for minor site plan approval, with no requirements for notice and public hearing. The scope of the review of the minor site plan would be limited to the criteria listed in the Bill.

U.S. Treasury Department updates Program Guidance and related material regarding Payments for Specified Energy Property in Lieu of Tax Credits under the American Recovery and Reinvestment Act of 2009:

This Guidance establishes the procedures for applying for payments under the Section 1603 Grant program for renewable energy projects and is intended to clarify the eligibility requirements under the program.
