     The six year term for Director of the Department of Insurance will expire for current Director Christina Urias in January, 2012. Director Urias was a Democratic appointee by former Governor Napolitano and so is not expected to be reappointed by current Republican Governor Jan Brewer.


     The ADOI Director has wide latitude to set policy. Director Urias has been singlehandedly responsible for the lack of enforcement of the chiropractic insurance equality law. A new Director could potentially reverse course completely and vigorously enforce the law as written. The "changing of the guard" at ADOI creates new worlds of possibilities for the chiropractic profession. Governor Brewer has a long history of fairness and so ACS is very optimistic about the new appointee.


     There will be intense lobbying surrounding this appointment. This is a time to be very grateful that ACS has retained the Rose Law Group to lobby for the profession. Lobbyist Tim La Sota will be very involved in lobbying for this appointment on your behalf.

     The Arizona Court of Appeals has set November 9th as the deadline for submission of legal briefs by both sides in the lawsuit against ADOI over enforcement of the chiropractic insurance equality law. The next step will be oral arguments followed by a ruling. The losing party will appeal to the Supreme Court but it is expected such an appeal will not be accepted and so the Court of Appeals decision will be final and binding. This decision should come no later than mid-2012.

Join Us As We "Run Drugs Out Of Town" Nov. 6th At Chase Field


Mark your calendar for Sunday, November 6th at noon.  That is when the Run Drugs Out of Town Run will start at Chase Field.  As a member of the largest drug free health profession we invite you to join us and there are two ways you can be involved.


The Run is for kids of all ages and goes once around the warning track and then you get to run the bases, sit in the dugout, and get autographs from some of the Diamondbacks and lots more.  Every runner wins a medal that says. "I'm a winner, I don't do drugs".  Needless to say this is a day full of memories and a message every parent and every chiropractor wants to give their kids.


So here are the invitation and the challenge. We invite chiropractors to participate and invite your patients to join your office as a centipede (a group running with a common theme).  Children will be allowed to run the quarter mile individually and then again as a group. The best centipedes will win a pizza party from Streets of NY Pizza.


The challenge is simple. Any patient who pays for the registration of a child, $12.50, give them a credit for that amount on their next visit.  Don't worry; you can afford to write that off as it will bring you plenty in good will and new referrals. The second part of the challenge involves the age old practice building technique of reactivating old patients.

      We are very pleased to announce that ACS has retained the Rose Law Group to lobby for chiropractic at all levels of Arizona government to protect the interests of the profession.      Last year we came very close to having our insurance equality law repealed. We simply cannot take any chance of having that happen again. The Rose Law Group will be our firewall against that possibility. Rose may be the single most powerful lobbying firm in Arizona and you now fall under their protective wing thanks to ACS.


      We have gone out on a limb financially to retain the Rose Law Group and so must raise funds to pay their fees. Therefore, we are inaugurating the ACS "25's to Success Program". With this program, we are asking all members to increase their monthly dues payment by a mere $25 to cover the cost of our new lobbyist. Only $25 more per month will buy you the security of knowing the Rose Law Group will be watching your back. Please begin with your next payment to add on the extra amount. If you pay with a credit card, please email authorization for ACS to charge the extra $25 per month. Just this small extra amount from every member will enable us to fully pay our new lobbyist. Honestly, $25 is chickenfeed compared to the benefits we will gain by having the Rose Law Group on our side. We know this is what you want and need and so thank you in advance for your increased contribution. If you have any questions, don't hesitate to ask.


     For those doctors not members of ACS, joining now to help pay for the Rose Law Group is a brilliant idea if you want a future in chiropractic in Arizona. This move by ACS should push you over the fence and finally get you to send in that membership application or sign up online, especially after you read about Rose online on their webpage. You want to be protected by the Rose Law Group and will be happy to chip in some money to help pay the fees. Once you join and dig into the Member Benefits and Practice Resources, you will kick yourself for not joining years ago. This information will create far more income for your practice than you will ever pay in dues. Just ask any ACS member if this is true and you will get an answer in the affirmative.


       ACS is on the move. We have a lawsuit in the Court of Appeals with the best appellate lawyer in the state to enforce our insurance equality law. Now we have the best lobbying firm in the state. Your ACS leaders have decades of experience. The turning point is near. ASH shall not stand in Arizona with ACS on the job. You can count on us.




ACS has two new dynamite documents in the Member Benefits. The first is 11.3 - Letter to fight refund demands. This is the most powerful letter of its type. If you receive a refund demand, contact ACS to work on strategy which will probably include this letter. The second is 34.1 -- Who Can an ARS 33-931 Lien Be Enforced Against, written by ACS PI attorney Steve Pincus. Many of you have called with perfected liens that insurers have not honored and asked what you can do to collect. Mr. Pincus wrote a position paper now available as #34.1 in Member Benefits. We highly recommend Mr. Pincus' law firms in Tucson and Tempe for your PI patients for high quality legal services, and in appreciation of the fact that Steve Pincus has been a Corporate Member and supporter of ACS and the profession for years. 






           The new ACS health insurance lien forms also work for medpay, UM and UIM insurance companies where County Health Care Liens do not work. You can file these liens with such carriers and they will have to honor them and send the checks to you. County Health Care Liens only work with third party insurers, not first party insurers such as UM, UIM and medpay. These liens are already proving to be of great benefit to ACS members in many PI cases where they previously had no protection for their bills.  


          ACS members have been sending the new lien forms into health insurance companies that do not honor assignments of benefits and none have yet stated they will not honor the liens. The ACS attorney is confident that the insurers will have to comply. This will be the end of the "check-chasing" game where the insurer sends payment to the patient and the doctor has to track down money that often is spent before it can be sent to the doctor.

          Teaching compliance with record keeping and documentation in Arizona has always been a paramount goal for ACS, and so we have assembled a packet of information that is the most comprehensive available. Read the fruits of ACS' investigation along with an outline of the course on record keeping given by the lead Board auditor, full course notes of a lecture on the subject by a former Board chair, Medicare Noridian requirements, CMS rules for reporting timed codes, and eleven key office forms to use to streamline your operations and documentation.




The Chiropractic Board requires you have a Medical Record Protocol on file and ACS supplies it here. We also teach you how to search the National Library of Medicine and retrieve articles from a medical library. In this section is a limited power of attorney form directing payments to the doctor when insurers other than BCBS deny assignments of benefits.           Personal injury tools include the Arizona Bar Ethics Opinion that requires attorneys to pay your bill if they know it exists. We also have a position paper you can use to defend yourself when attorneys want you to pay 1/3rd of the collection costs, and when they want you to accept what the health insurance company has paid as payment in full, i.e., no balance billing. This section also includes all forms needed file County Health Care Liens, a Circular Letter from the Department of Insurance mandating fair investigations of low speed impact automobile accidents which can be used to combat insurance company fraud, and three invaluable forms for your PI practice.




                ACS Attorney David Abney has developed new lien forms that will force insurance companies to send checks directly to you even when the deny assignments of benefits. BCBS has initially refused to honor these new liens and so we expect to have to litigate to force them to do so. We intend to litigate to gain enforcement of our new liens, and have initiated a fundraising campaign for the lawsuit. No other health insurer has yet reacted to the new liens.


                The liens will also work in PI cases and in fact give the provider more rights than County Health Care Liens. We still recommend filing County Health Care Liens, but these liens cannot be filed in UM, UIM or medpay cases and so the new ACS lien is the only lien that can be filed in such cases. It is highly recommended that the ACS lien be filed in these cases. These liens are a very special new member benefit for ACS members.
