National Harmonisation Update
The finalised Model National OHS Act was approved in December 2009. Over the next two years the Act will be made into law in the respective States and Territories. This may be a staggered process across Australia as State and Territory parliaments will sit at different times to enact laws.
The next step of the process is the creation of the Model Regulations. The National draft model regulations are due for release for public comment in November 2010.
When the Act and Regulations are adopted by the state governments, businesses will need to understand any changes from the existing legislation that may affect existing health and safety obligations.
