Do I Need a Guardianship?
Be Sure To Explore Less-Restrictive Alternatives First
Spouses or other family caregivers of loved ones with dementia are often advised to get guardianship in order to be able to make medical and financial decisions. However, guardianship should only be sought after all other options are exhausted. Before filing for guardianship, be sure to ask:
- Is there a Durable Power of Attorney and/or Advance Directive already in place? If so, guardianship may not be needed.
- Can my loved one still understand enough to sign a Durable Power of Attorney or Advance Directive? Just because a person has been diagnosed with dementia does not mean he or she has lost the ability to understand and consent. Each person's capacity should be evaluated individually.
- Will the guardianship be contested? The person over whom a guardianship is sought as well as family members have a right to be notified. Think about how they will respond before filing the guardianship petition.
If guardianship is necessary, be sure to understand the roles and responsibilities of the guardian. For more information about adult guardianship, see the booklet Striking a Balance available from the Senior Law Resource Center's website. |
