Does the Insurer Treat Catastrophic Injuries Differently? |
The severity of a work injury shouldn't inhibit a comp award. But in fact, is a claimant treated differently if the injury is severe? Tonight at 7 PM on WFMZ-TV 69, The American Law Journal presents "Workers' Compensation: The Catastrophic Work Injury" with claimants' attorney George Badey of Badey Sloan & DiGenova, respondents' counsel David Pennington of Edelstein Law, Dennis Straub of the Pennsylvania Federation of Injured Workers and the Hon. Geoffrey Dlin. The panel examines how the severity of injury can hamper the claims process. "You bet the insurance company treats you differently if it's a catastrophic injury," claims Badey. "The numbers are higher so it begins to take on the feel of a personal injury case. Even though fault has no place in a comp matter, you'd be surprised how often that notion is tossed into negotiation or settlement conversation."
