Workers' comp benefits rarely, if ever, approximate a personal injury award. So isn't it incumbent upon claimant's counsel to overturn every stone to determine if there is third party liability? And isn't it tantamount to malpractice if they don't? Sunday at 6:30 PM on CN8, The Comcast Network The American Law Journal presents "Work Injury & Third Party Claims: Finding a Way Around the Comp System " with claimants' attorneys Mark Schmidt of Schmidt Kirifides Pearson Koutcher & Fridkin and George Badey of Badey Sloan & DiGenova. The panel also examines subrogation, bad faith and how claimant's counsel can maximize benefits when there is absolutely no basis for a third party claim.
"Good plaintiff's lawyers will do whatever they can to blur the edges of what can be quantified," says Judge Dlin, "so that they can have more flex and wiggle room within the defined parameters that [they] have to work with. And good lawyers can do that by arguing everything that [defense counsel] puts forth on the table . . . and that makes the box bigger."
