From the IME to the IRE, workers have been scratching their way back to recoup losses in Pennsylvania workers' comp matters. But will the recent vacating of the Diehl v. WCAB decision ultimately set them back?

Worker's compensation judge the Hon. Geoffrey Dlin helps examine recent trends in the ongoing battle of injured workers keeping benefits versus going back to work. When is an injured worker fully disabled, partially disabled or considered ready to return to work full-time?
"It was a big sigh of relief for claimant's attorneys when Diehl came out," said Schmidt about the case that stung employers for not requesting an injured worker's IRE in a timely manner. Schmidt opined that that such relief would "probably be temporary since the court added something that might not belong there." Indeed, the Commonwealth Court recently vacated the Diehl decision, pending re-argument en banc to be heard on or around September 8th.
