Legislative Update The budget, or lack thereof, dominated the entire session. We still do not have an adopted budget, as the Senate has yet to approve certain revenue provisions. Accordingly, the Comptroller cannot certify the budget as being adopted, and legislators are not being paid. Appropriations for state agencies and capital projects have been approved and the threat of a shutdown no longer exists. The governor is calling the legislature into special session this Wednesday, July 28, but he cannot force them to take any action. Here is an update on the status of the 2010 Legislative Program. For 2010, AIANYS top priorities were: Alternative Project Delivery and Non-Design Professional Ownership. AIANYS also supported: Qualifications-Based Selection of Professional Design Services, Good Samaritan Act, Design Liability Reform, Historic Preservation Tax Credit, Smart Growth, Professional Certification, prohibition, Criminal Prosecution for Building and Fire Code Violations, Construction Threshold, and Damages for Delay. PASSED BOTH HOUSES: Historic Preservation Tax Credit would strengthen the historic tax credit program by allowing banks and insurance companies to claim the credit for rehabilitation of historic commercial and residential properties. A subsequent revenue bill passed by the Assembly, but not acted upon by the Senate, delays the full implementation of the tax credit. Smart Growth (A.8011) would add a new article to the Environmental Conservation Law, requiring various state agencies to apply a series of smart growth criteria when making financing decisions for new public infrastructure construction or reconstruction projects. Awaiting delivery to the governor. PASSED ONE HOUSE: QBS (Qualifications-Based Selection of Professional Design Services) was passed by the Assembly, but not the Senate. This bill requires public authorities to negotiate with most qualified architectural and engineering professional firms before negotiating with other firms. We are hopeful that the Senate will act upon the bill when it returns. Good Samaritan Act was passed by Senate, but died in Assembly committee. This legislation is important to design professionals as they can provide essential services during natural or man-made disasters and emergencies to help protect the public, with the confidence that there will be sufficient immunity from liability while providing these services. DIED IN COMMITTEE:Alternative Project Delivery, Non-Design Professional Ownership, Design Liability Reform SUCCESSFULLY OPPOSED: We were successful in killing the following bills which we oppose: Professional Certification prohibition, Criminal Prosecution for Building and Fire Code Violations, Increasing the Construction Threshold at which the services of an architect are required, Damages for Delay.
For a full description of the bills above, go to: http://www.aianys.org/government/program.htm.

Are you in need of CE Credit? (Letter from George Miller, FAIA, AIA President) Although sustainability has been a focus of architectural practice - and of the AIA - fore more than 30 years, the need and opportunities have never been greater for architects to lead society towards a more sustainable built environment. The new education requirement was added beginning with the 2009 calendar year, to ensure that all AIA architects are not only knowledgeable about sustainable design (SD) but also prepared to meeting burgeoning client demand for it. The requirement itself is modest: Each active architect member must earn four learning unit (LU) hours of SD education each calendar year. This field now offers an immense choice of courses that help architects to stay current in their profession and ahead of the demand curve. You might not know how quickly and easily you can earn the required four SD LUs, which also count toward the annual health, safety, and welfare (HSW) requirement. Some SD-qualifying courses are even accessible on-demand, from the comfort of your own home or office. One of these convenient options may be right for you:
Complete your SD requirement right now for free: Four free online sessions from the 2009 AIA Convention remain available, on demand.
View brand-new SD sessions from the 2010 AIA Convention: Twenty new SD sessions (earning a combined total of 23.5 LU's) have just been posted-all of which also qualify for maintenance of LEED credentials (see the sidebar link for more information)
Select courses from AIA Continuing Education System (CES) Providers:
From the search engine at www.aia.org/education/findcourses, select "yes" under the "sustainable design" pull-down menu. You can customize your search even further by date, location, cost, and other options.
Check with your local and state components for more SD education resources, including courses that may be present soon near you.
Whichever option you choose, please don't delay. Your membership is important to us, and the grace period to apply LUs to the 2009 requirement ends on September 30, 2010. |
