Supreme Court Considers Constitutionality of Provisions of Health Care Reform Law

Oral arguments before the Supreme Court on the Patient Protection and Affordable Care Act (PPACA) were held on March 26-28. Clearly, the outcome of the Court's deliberations will have a monumental impact on both the general environment as well as the specific rules that will prevail in O&P and all aspects of health care in the coming years. There was more than 6 hours of oral arguments on this landmark case.  Much has been written about specific questions asked by each justice, and what they might mean, but we will likely not know the outcome of the case until a ruling is handed down, probably in June. We have summarized the key issues that are being tackled by the Supreme Court during the arguments and how they relate overall to deciding the case. The first issue was whether the Court was precluded, based on the Anti-Injunction Act, from hearing challenges to the constitutionality of the individual mandate until 2015 - the date by which individuals would first be required to pay the penalty for failure to purchase insurance. Next, the Court focused on the highly controversial issue of the constitutionality of the so-called individual mandate--the provision that most individuals must purchase health insurance by 2014 or face a penalty. Additionally, this case explored whether, if the individual mandate is deemed unconstitutional, that provision is severable from the remainder of the broad sweeping law or, alternatively non-severable and thus the entire law must fall. Lastly, the Court explored whether the expansion of Medicaid (which requires participating states to include millions of previously uninsured low-income citizens in their Medicaid programs to remain eligible for Medicaid funding) is impermissible coercive.

Senator Ben Cardin Sends Letter to CMS Regarding Recent OIG Report

A few weeks ago AOPA had the opportunity to speak with Senator Ben Cardin (D-MD) about the OIG report, and in response to AOPA's concerns he has generated the attached letter to CMS Administrator Tavenner expressing concern about the impact the OIG report and follow-up contractor actions may be having on quality and timeliness of Medicare amputee beneficiary patient care.

It is worth noting that CMS headquarters is based in Maryland, and is, at least in terms of budgetary dollars (if not constituent employees) the largest government agency housed as a constituent in Senator Cardin's state. That fact, together with Sen. Cardin being a member of the Senate Finance Committee, probably accentuates both a bit more attention likely to be paid to the message by CMS, as well as his being a bit less prone to undertake intercessions with CMS lightly.


Also attached is a letter AOPA gave to Senator Cardin as an example of how O&P folks are caught in the middle of the CMS fight with physicians over documentation.  Senator Cardin's office has promised to keep us informed as to follow-up on this letter.

Sen. Cardin also became the fourth member of the important Senate Finance Committee to support the Medicare O&P Improvements Act (S. 2125) when he signed on as a co-sponsor, joining Senators Wyden, Grassley and Snowe.

Advance O&P When Contributing to Presidential Candidates 

Reminder:  A small group of politically minded AOPA members are leading the effort to create some O&P identity with the five contenders still in the race for the presidency.  The GOP primaries have winnowed the candidate list down to just four plus President Obama as the candidate for the Democratic party.  This effort is outside the O&P Political Action Committee but represents an innovative way to participate at the highest levels and to have some White House recognition in the next administration.  AOPA and the participants in this effort are not making recommendations regarding which candidate should be supported financially - just urging that if you choose to make a contribution to a presidential campaign - write the appropriate identifier number below on your check that is associated with the candidate of your choice.  In Ron Paul's case it must be a personal credit card contribution made on line.

PDAC Coding Reminder for L1906

Just as a reminder beginning April 1, 2012 the only devices that may be billed to Medicare using code L1906 (ANKLE FOOT ORTHOSIS, MULTILIGAMENTUS ANKLE SUPPORT, PREFABRICATED, INCLUDES  FITTING AND ADJUSTMENT) are those which have received a Pricing, Data Analysis and Coding (PDAC) verification and are listed on the PDAC website.

COPL Issues RFP for $15,000 Pilot Clinical Research Grants 

The Center for O&P Learning and Evidence Based Practice (COPL) has issued the Request for Proposals 2012-2013 Opportunities for O&P Clinical Research grants funded by AOPA.  The grants have been doubled in size to attract more research interest and in keeping with prior protocol the COPL Board will review all submissions and recommend those proposals meriting funding to the AOPA Board of Directors.

Deadline for submission is April 30, 2012 and it is expected the review process will be completed by June 30, 2012.

95th Annual AOPA National Assembly and Combined NE Chapter Meeting Historic Downtown Boston - The Place to Be September 6-9

Boston is the place to be as we build on our historic heritage and learn to prepare for the rapidly changing healthcare environment.  The clinical committee has been working hard to ensure the sessions will provide cutting edge science with clinical correlation to help expand our skills and improve patient care.  The meeting will kick off on Thursday, September 6 at 8:00 AM with two tiers of workshops or the option to partake in the Annual Fall Thranhardt Golf Classic.  All will meet back at the Hynes for the opening reception in the exhibit hall on Thursday evening.
