Labor Day is just around the corner and we wish everyone a fun, safe and lazy weekend holiday! Also just around the corner is the 10th anniversary of the attacks of 9/11. 'Anniversary' seems more appropriate for a positive event, we all know this is a time of prayer and remembrance. Although we did not personally know anyone killed, hurt or lost in the attacks, we are very close - as are all of us - with many who did. Karen's Corner: A CCDI Crossword Puzzle! (Karen S. Beers, BSW) | I received a lot of positive feedback from last month's puzzle. The answers from last month are posted, and a new puzzle is up and ready for you to print and tackle.
This month I am honoring my first investigative certification - Certified Criminal Defense Investigator (CCDI), which I earned with Dean, from the Criminal Defense Investigation Training Council (CDITC). Did you know that we are one of three couples in the US that sharing this designation? Just some interesting trivia - there are many CCDIs throughout the country - working in the private sector and for public defender offices at both the state and federal courts. This was quite a challenge, as is this month's puzzle.
The CCDI is based upon the training program, experience and 'Component Method' of investigation. The primary study material for the examination is derived from 'Criminal Defense Investigation - Uncovering Reasonable Doubt', by Brandon Perron, CCDI, and CDITC National Director.

As mentioned at the beginning of the newsletter, and for Karen's puzzle, we are both pretty excited to have been awarded the designation Certified Criminal Defense Investigator, or CCDI. This is specifically by the Criminal Defense Investigation Training Council (CDITC - www.DefenseInvestigator.com), started by long-time friend and well-known investigator Brandon Perron.
About the CCDI
The CCDI designation is awarded to professional criminal defense investigators who have met the minimum training and experience requirements required to perform effectively within the discipline of criminal defense investigation as an expert. Investigators seeking the CCDI designation are evaluated by the Academic Director and Executive Council on an individual basis. The applicants must meet the minimum requirements enacted by the board in order to qualify for the CCDI designation. Brandon also appointed me to the Faculty Advisory Board for Forensic Investigations. In June I presented a full-day Medicolegal Death Investigation program and will be expanding that to Colorado and other states. Podcasts and Blogs One investigator with PPIAC mentioned that she frequently downloads podcasts and programs to listen to while driving or other activities. Sometimes it is difficult to be available when a program first airs, and often it is easier to listen while driving, waiting at court, on a plane, etc. Blogs do require you to sit, but it is at your own convenience, and a lot of information can be found. Here are some podcasts and blogs we are aware of, and some we have participated in.

Five Qualities of a Professional Investigator...
| Skills Appropriate for the Assignment Law firms and medical offices specialize - Professional Investigators also specialize. Their casework and continuing education should also be in your specialized areas.
Experience and Knowledge Professional Investigators strive to maintain and further these. All professions have requirements of continuing education. The CLI program requires extensive compliance with continuing education.
Responsible and Ethical Conduct Every component of the investigation has evidentiary considerations. Professional Investigators hold themselves to a higher standard and leaves no question as to the admissibility of their evidence. Information without ethics is not evidence.
Effective Communication Professional Investigators maintain communication with the attorney, client, witnesses, and other key persons in the investigation. Moreover, reports are the product of an organized investigation and should reflect the work product you expect.
Keyword - 'Professional' Honesty, Integrity & Intelligence. These define Professional Investigators and gives you the confidence that your case is in competent and skilled hands.

In Closing...
| Evidence is either circumstantial or direct - and in court, they are given the same weight by the jury. Is one more reliable than the other? During trial this is one battle that ensues - whose evidence is better, what type of evidence is better, and is the evidence valid?
We have all heard analogies to explain one type of evidence being more believable than the other. Here are two:
-- You have a bowl of milk on the counter and briefly leave the room. When you return you find the bowl empty and the cat licking his paws. Did the cat drink the milk?
-- You are staying in a cabin and decide to hunt for rabbits. Having no luck, and deciding there are no rabbits to hunt, you return to the cabin and go to bed. The next day you wake up and find snow on the ground - and rabbit tracks in the snow. Did it snow? Are there rabbits?
The former is not clear, sure it is likely the cat drank the milk. But you didn't see what happened to the milk. Should there be any reasonable doubt in your mind? In the latter it is clear that it snowed, and that there is a rabbit out there. But, you didn't see it snow or see the rabbit. Should there be reasonable doubt in your mind? One could argue the former is less definitive than the other.
In civil and criminal cases, and at times probate cases, the evidence plays a key role. It must be followed and connected - not necessarily in a linear fashion, such as a chain, but often in a cellular fashion, such as a map of cell sites with each site connected to multiple sites by the facets of the hexagon. An interruption of the evidence, similar to a cell site, also breaks the nexus of one piece of evidence to another. Locard's Principle states that with every contact is a trace. It goes on to state that other evidence must complete the circumstances of the direct evidence. A fingerprint on a window only confirms that the person identified to the fingerprint touched the window. It does not identify when, why, how or with what intention. Therefore, direct and circumstantial evidence are wholly reliant upon each other, and should not be considered only of themselves.
Evidence to Person, Person to Scene and Scene to Evidence are common examples of direct evidence working with circumstantial evidence. In these three examples the conclusion of one match (i.e. Evidence to Person) is not case conclusive, neither are two matches (i.e. Person to Scene and Scene to Evidence). It takes a conclusion of all three to be case conclusive.
