Voluntary Licensure of Private Investigators in Colorado (Dean A. Beers, CLI) |
The ongoing effort of the PPIAC to have professional licensing of private investigators in Colorado continues. Colorado was one of the first states to license private investigators, and the first law passed by Colorado was to license private investigators, that was in 1877. 100 years later, in 1977, the law was declared unconstitutional due to lack of clear definition. 34 years later efforts continue to correct that. The PPIAC was founded in 1978, in part, to facilitate the licensing effort. Colorado remains one of a handful of states without licensing, protection for consumers, private investigators and businesses.
Dean was interviewed for this article, written by Garrison Wells, who has worked as an investigative journalist for the Rocky Mountain News, and in the private sector. There is a quote of opposition that "We are going to have the lowest standards in the country," Well, in response to that - no licensing IS the lowest standard in the country, the longstanding efforts of the PPIAC licensing committee has been to raise those standards. As to the impact of being licensed in another state, as many reluctantly are, those are some of the lowest for mandatory licensing and there is no protection of the consumers, private investigators or businesses. It does offer limited title protection to private investigators. A voluntary licensure program in Colorado will offer these protections.
"You have a division of people who want regulation and see the need and you have another group that sees no need for it or oppose it for one reason or another," Beers said. "This gives everyone an opportunity to make the decision themselves."
Beers added that licensing "provides an unobstructed pathway for people getting into the field to gain the experience to get a license."
"With voluntary, you can opt out. It provides the free market a way to balance things as to who is participating and who is not."

Professional Private Investigators Assoc of Colorado ( www.PPIAC.org)
On the licensing front, progress of the Voluntary Licensure of Private Investigators continues to make unprecedented progress! As of this writing, it has now passed the Senate Judicial and Finance committees, and now moves to Appropriations and then the full Senate for final votes. After passage by the Senate it will go to a joint committee for reconciliation of technical amendments and then to Governor Hickenlooper's desk for signature. This has been a long process and we are looking forward to passage of this bill. The legislative session ends the second week of May - 05/12. Please consider the importance of this bill to the investigative and legal communities and consider writing letters to all of the Senators! (Senate Directory) or email our office and we will send you a spreadsheet to import into your contacts (email Forensic Investigators of Colorado, LLC).Planning for the PPIAC annual fall conference is now beginning and is now set for September 23rd and 24th, with a special and separate seminar scheduled for September 22nd!. As planning continues updates will be posted on the association website and newsletter, and this newsletter. Also, the latest newsletter is also available (March 2011): National Association of Legal Investigators ( www.NALI.org) The annual conference for NALI is in San Francisco, CA from June 16th to the 18th, with examination of Certified Legal Investigator applicants. Annual elections will also be held. The agenda and speakers are still being finalized, some components, including a forensic facility tour, are planned.

MICHAEL HAGGARD - INTERNATIONAL ACADEMY OF TRIAL LAWYERS
Michael Haggard, partner at The Haggard Law Firm, was recently inducted as a Fellow into the International Academy of Trial Lawyers (IATL). The Academy is recognized as the most prestigious organization of trial lawyers in the world. The induction ceremony took place during the Academy's 2011 Annual Meeting, which was held at the Mandarin Oriental Hotel in New York City.

DOES "HOPE OF BENEFIT" NULLIFY A CONFESSION?
In the case of State v. Brown (March 2011) the Court of Appeals of Georgia found that a statement to the suspect by the interrogator that "no matter what you tell me or say... you're going home" did not create such a "hope of benefit" when viewed in light of the totality of circumstances.
ACCIDENTAL DEATH BECOMES SUICIDE WHEN INSURERS DODGE PAYOUTS
Jane Pierce spent nine years struggling alongside her husband, Todd, as he fought cancer in his sinus cavity. The treatments were working. Then, in July 2009, Todd died in a fiery car crash. He was 46. That was the beginning of a whole new battle for Jane Pierce, this time with Todd's life insurance company, MetLife Inc. A state medical examiner and a sheriff in Rosebud County, Montana, concluded that Pierce's death was an accident, caused when he lost control of his silver GMC pickup after passing a car on a two-lane road.
