Trustee Declaration

All Trustee's must complete a "Trustee Declaration" in the ATO prescribed format, if they become, on or after 1st July 2007, a NEW Trustee (or Director of Corporate Trustee) of
- New Self Managed Superannuation Fund or
- An existing Self Managed Superannuation Fund
They must sign this declaration within 21 days of becoming a Trustee or Director of Corporate Trustee of a SMSF.
Before the Trustee's sign this declaration, they have to ensure that they have read each section and understood all information it contains.

 Trustee Declaration has to be singed by all Trustee's in presence of a witness. Can an advisor (accountant / financial planner etc) be this witness ?
The answer is YES.

It is possible, that some Trustee's may lapse in performing some of their Duties and Responsibilities. By witnessing Trustee's Declaration, the advisor is (unnecessary) exposing himself to future claims as it can be construed that the advisor had a duty of care in ensuring that the Trustee understood (100%) all responsibilities as a Trustee of SMSF before signing the declaration.
In our opinion, it (declaration) is ATO's measure to ensure that all trustees are held personally liable for their actions as Trustee's of their Self Managed Super Funds. Be ready for some court cases and unless you enjoy being sued do not witness the Trustee's signature.
