ORC Hearings Advance Need for "E-Fencing" Regulation
As a result of the Virginia Retail Federation's participation in a national coalition and communication with Congressman Bobby Scott (D-Newport News), congressional hearings were held last week on Organized Retail Crime (ORC). The hearings addressed the need for online auctioneers to register large-volume sales. Representing the Virginia Retail Federation, the only state association in the national coalition, Retail Alliance staff attended the hearings and discussed the issues at length with Congressman Scott.
Scott chairs the Judiciary Subcommittee on Crime, Terrorism and Homeland Security. At the request of Retail Alliance, he introduced H.R. 6713, the "E-fencing Enforcement Act of 2008," late last summer. Moreover, two bills also included in the hearings, H.R. 6491 and S. 3434, make ORC a federal crime.
At the hearing, representatives from e-Bay and other online marketplaces contended that retailers want to regulate internet sites in order to cut down on competition. Retailers adamantly disputed this point. ORC costs retailers an estimated $40 billion a year in stolen goods. While traditional flea markets and pawn shops used to serve as the primary outlets for retail thieves, online ORC is growing rampantly and shows no signs of slowing.
"We are not going to stop looking at this issue," vowed Congressman Scott. The Coalition Against Organized Retail was formed in 2001 to organize retailers, retail associations and product manufacturers impacted by the crime. The recently introduced bills will give retailers better tools to address the enormous losses generated by ORC. (September, October Loss Prevention Magazine).
