IABAC Stands Up for Producers
IABAC- the Only Agent Association to aggressively advocate against onerous CDI homeowners' replacement regulations
The California Department of Insurance (CDI) held a public hearing (May 17th) on new proposed regulations establishing onerous standards, training and record-keeping requirements on homeowners' insurance valuations issued by insurance agents and brokers. CDI claims the proposed rules are to ensure that homeowners have a more accurate replacement value estimate for their homes in order to prevent under-insurance, a CDI perceived problem following disasters like the California wildfires. IABAC believes that the new regulations are unnecessary and will impose overly-burdensome requirements on insurance producers acting as fire and casualty broker-agents and personal lines broker-agents. Specifically, CDI is proposing the following rules ostensibly to ensure the accuracy of homeowners' insurance replacement value estimates:

  • A new regulation requiring licensed fire and casualty broker-agents to take a comprehensive three-hour training course on homeowners' insurance valuation which will be an ongoing continuing education requirement and will beused in all subsequent testing. The first course must be taken before you can solicit homeowners' insurance - and within 90 days of implementation of the regulation.
  • A new regulation requiring any licensee who provides a replacement cost or construction cost estimate as part of a homeowners insurance quote to document and maintain extensive records of the estimates and quotes for three years even if the individual requesting the quote never purchases a policy!
  • A new regulation which creates for producers a legal obligation as well as violations of the insurance code for failing to conform to the new standards relating to replacement cost estimates. Producers will additionally be responsible for estimates obtained from other sources. It also places the same obligations on insurers in situations in which the insurer provides the producer with the source or software tool to create the estimate. A requirement which IABAC believes unfairly opens up agents and insurers to liability from third party actions over which they have no control.

IABAC President Joe Jimenez and Bob Hogeboom, of Barger & Wolen, IABAC's legal counsel, testified at the May 17th hearing in Los Angeles requesting that the CDI withdraw the regulations on the basis that the standards in the regulations and the creation of code violations are not authorized by statute. IABAC was the ONLY producer trade association that called for a complete withdrawal of the proposed regulations. Joining IABAC were three insurer trade groups representing a majority of California insurers. 

"These proposed regulations will be a complete disaster for insurance agents and brokers in California," stated Jimenez. "Our state already has one of the most hostile insurance industry regulatory environments in the country. These regulations will only make a bad situation worse. We are pleased that three of the largest insurer carrier trade groups have joined IABAC in opposing the regulations."

In addition to the multitude of problems with the regulations themselves, IABAC legal counsel believes that the CDI lacks the proper authority to promulgate the proposed regulations.

Proposition 17
YES on Prop 17!
The Insurance Agents and Brokers Association of California strongly supports Prop. 17, the Continuous Coverage Auto Insurance Discount Act, on the June 8th ballot.  The initiative allows drivers to take their continuous coverage discount with them if they decide to change auto insurance companies - saving drivers up to $250 a year!
 
What's the problem?
Under current law, drivers who have maintained auto insurance with the same company are eligible for a continuous coverage discount. However, a flaw in law prohibits drivers from taking this continuous coverage discount with them if they switch insurance companies.  Responsible drivers who maintain their insurance coverage pay a surcharge of hundreds of dollars if they switch insurance companies, because they lose their continuous coverage discount. 
 
The Solution = Prop. 17
Prop. 17 ends that penalty and allows drivers to keep their continuous coverage discount even if they change insurers. By making this discount portable, Prop. 17 will reward the more than 80% of responsible California drivers who maintain auto insurance, as required by law.

3)   Display your support for Prop. 17!  Download posters directly from the Yes on 17 website to print out and hang in your office!
 
4)   Post an article or a link to Prop. 17's site on your website!  When customers visit your site, they'll be able to learn more about Prop. 17 and how it will benefit over 80% of drivers.
 
5)   Join the coalition, become a fan on Facebook or follow the campaign on Twitter and stay updated on the fight to pass Prop. 17!
