Medi-Cal program's implementation and interpretation of section 51008.1 of
Title 22 commonly referred to as the Upper Billing Limit (UBL).
This regulation was adopted in 2004 under the auspices of eliminating fraud and
abuse. CAMPS members and providers throughout California are being
audited based on this regulation and are experiencing recoupments as a result

Action Needed: Urge Your Representative to Join Hall Letter Requesting Transparency in Bid Process - Deadline August 9
Please take action on this urgent matter today:
Call your member in the House of Representatives and request that he or she
contact the staff of Rep. Jason Altmire (D-Pa.) or Rep. Ralph Hall (R-Texas)
and agree to sign the congressional letter requesting transparency from CMS in
the "competitive" bidding program.The deadline for signing on to the letter is Monday, August 9, 2010.
Representatives Altmire and Hall circulated a letter to every member of the
U.S. House of Representatives on Monday, August 2, asking for signatures on the
letter to CMS, requesting the agency make public the list of providers, product
categories, and corresponding competitive bidding areas for those bids that
were used to determine the single payment amounts in the nine bidding areas.
The congressional letter asks CMS to respond no later than Friday, August 13,
in order to enable Congress to assess the program's ability to meet the medical
needs of constituents.
AAHomecare is very concerned that the bid rates announced in July are
unsustainable and will negatively impact patients' access to needed HME. Unfortunately, CMS has not released any detailed information regarding the bid
rates or process, including identifying HME providers who were offered
contracts. It is the understanding of the Association that a number of
members of Congress are concerned about the re-bid process and would like CMS
to provide information so the impact on Medicare patients can be determined.
While the Association is urging members of Congress to sign on to this
important letter to CMS, it is important that lawmakers also hear this request
from their constituents as well. So please make a call today and follow-up with
