Court Denies CAMPS Petition To Repeal Medi-Cal Upper Billing Limit Regulation
 

Earlier this week an Alameda Superior Court Judge denied the CAMPS motion for Writ of Mandate to repeal the UBL regulation. The ruling is obviously disappointing and the order itself simply ignores most of the issues and facts we had raised. The Judge concludes that DHCS had authority to promulgate this regulation under their broad authority to prohibit fraud and abuse. He deemed the record to be sufficient to warrant the adoption of the UBL and that such action was not arbitrary and capricious. We thought it was clear that the record contained no documentation of how the 100% was arrived at or that it was reasonable when applied to anything from a syringe to a custom wheelchair.
 
We have 60 days from the formal entry of judgment, which has not yet technically occurred, before we need to file a notice of intent to appeal. We will be reviewing the ruling with outside legal counsel and the Board will then decide whether to file an appeal.I will be discussing that with outside counsel and then setting up a similar discussion with the Board to make a decision.
