TODAY: People and Jobs on the Move:  Implications for U.S. Competitiveness
Office of Civil Rights Presents:  Dr. James H. Johnson, Jr.
 
Two powerful and "colorful" demographic forces-the "browning" and "graying" of America--and one emergent and dynamic economic trend -the so-called "second wave" of globalization-will profoundly re-shape the form and function of U.S. social, economic, and political institutions in the years ahead. Heightened immigration from Latin America and Asia combined with the aging of the native born population (especially the post WW II baby boom generation) will dramati-cally transform the racial and ethnic composition of the U.S. population and create demand for a more diverse workforce.

At the same time, the accelerated offshore movement of white collar jobs to India, China, and other emerging market countries will challenge the ability of the U.S. to compete for talent and foreign direct investment in the highly volatile and speed driven global economy of the 21st century. In this lecture, I will provide an overview of these developments and assess the implications and challenges they pose for our nation.

GLIFAA Transition Letter
GLIFAA Goal: 5000 Signatures

By now, many of you have seen (and hopefully signed) our letter to the incoming Secretary already, and as I write this, we have received more than 725 signatures. I have been personally overwhelmed by the support of our colleagues, as nearly 90 percent of those who have signed do not have an MOH and therefore stand to gain nothing immediately by signing. They are signing because it is the right and fair thing to do.

Seven hundred twenty five signatures in just over two weeks is great, but we want more. We want to make sure this letter gets the widest distribution possible, because the more who sign it, the more of an impact it will make. So we need you not just to sign it (but please do sign it if you haven't already), but to forward it as well. I noticed that after I posted the letter below to my A-100s yahoo group, a large number of my A-100 colleagues signed the letter to the Secretary. I believe the personal connection really makes a difference in getting people to sign, so I encourage you to forward the letter below, including the link

In my case, I reminded my classmates that I had faced these inequities when I was a member of household and that those difficulties are what led me to join the service. I noted that while this was a good decision for me and my family, it is not a decision everyone can or even should have to make.

Please be assured, and assure your colleagues, that we have much more substantial documents for the transition team that go into detail about the issues facing LGBT service members and their families, and that we have gotten permission and clearance to send out this letter from both the DG and U/S for Management Kennedy.

Dear Friends and Colleagues,

With the recent news coming in about our next Secretary, we've reached a critical time and would like make sure equality is on her agenda. GLIFAA (Gays and Lesbians in Foreign Affairs Agencies) is asking all colleagues to consider signing a letter of support to tell the new Secretary how important it is for morale that all of us be treated as equal members of the same team.

I hope you can take a moment to visit http://sites.google.com/site/glifaaletter (cut and paste in separate window if necessary) and sign your name. Take a look: it's simple - nothing controversial in there.

Following that, I hope you can encourage all your friends and colleagues to do the same by forwarding this message. We welcome signers from all of the foreign affairs agencies, and from both civil service and Foreign Service employees - we really need as many allies as we can in order to be noticed.

GLIFAA News Update
From the Policy Director, Ajit Joshi

First, for those of you at State, AFSA has a survey that is critical to us.  If you haven't already done so, log on to the AFSA poll. Question 12 asks, "Should AFSA advocate for official recognition and benefits for same-sex domestic partners of Foreign Service members?"  The board asks that you add one or two sentences about how/why this issue is important to you in box 22 ("Please give us your ideas").  We very much need AFSA's support at this critical time, and we hope you will help us send this message to the AFSA leadership.

November was a busy month for GLIFAA, with the excitement surrounding the presidential elections, and the historic opportunity in front of GLIFAA - to provide input into the Presidential transition process.  GLIFAA has drafted transition materials and seeks appointments with transition teams in the foreign affairs agencies to argue the case for equality and fairness. 
 
GLIFAA President J. Michelle Schohn, Policy Director Ajit Joshi and Executive Officer Kerri Hannan met in November with the State Department's Under Secretary for Management Pat Kennedy (M). 
 
U/S Kennedy said his goal, as GLIFAA's mentor, is to make State (and presumably other foreign affairs agencies) a better place to work.  He recommended that GLIFAA be aware of policy, laws, and politics and pursue two parallel tracks: (a) work within the system, and (b) work with the transition team.  He suggested two approaches - transition team come up with new regulations as of January 20 AND for the current Administration to talk to them about problematic implementation of current authorities.
  • He encouraged GLIFAA to continue outside stakeholder conversations with NGOs and the Hill.  He encouraged GLIFAA's platform to say that State has the legal flexibility to do X, Y, and Z, and State ought to follow through on X, Y, and Z.  The ultimate question is whether State feels it has the policy/political green light from current Administration or that of the President-Elect. 
  • U/S Kennedy encouraged GLIFAA to note that the Foreign Service Act does not define EFM.  He urged GLIFAA to stay focused on the key goal of redefining EFM to include MOH
  • Michelle and I expressed concern that Transition Teams at other Agencies are not including diversity, LGBT issues, or MOHs issues robustly. 

We presented U/S Kennedy our transition papers, and he provided us with some feedback:

  • U/S Kennedy said he will talk with AA/M at USAID regarding updating the non-discrimination clause in grants and contracts to include sexual orientation and gender identity.  Will also talk at State about PD grants, Fulbright grants, Ambassador small grants
  • He recommended that the transition paper and cover memo highlight the members of Congress who wrote to the Secretary (for example, Berman is Chairman of the Foreign Affairs Committee and Ros-Lehtinen is the Ranking Member on the House Foreign Affairs Committee. Ackerman is a member of the full Foreign Affairs Committee and Chairman of the House Subcommittee on the Middle East and South Asia that is a key panel of the House Foreign Affairs Committee). We have since incorporated those suggestions into the documents that will be given to the transition team. 

U/S Kennedy also responded to GLIFAA's one page position paper: 

  • On badges/IDs, he asked that GLIFAA provide examples of countries to him and his special assistant Kerri O'Connor where members are not getting ID badges.  He said he has spoken with DS A/S Eric Boswell and PDAS Greg Starr and been assured that all MOHs receive yellow badges.  He took GLIFAA's suggestion of an ALDAC on ID badges and family support groups
  • We apprised U/S Kennedy that MOHs are able to get Rosetta Stone only on a space available basis.  [Note: after the meeting with U/S Kennedy, we learned from a USAID DLI that her partner was told "no" for FAST language training and we are following up with DG Thomas on that issue.] 
  • We told U/S Kennedy that we consider full language courses and the separation course to be security issues, and he concurred that one good way to bring about change was to point out the security issues created by the current system. 
  • On FEHBA, he will look at the options.  

U/S Kennedy said he thought that GLIFAA's letter writing campaign was a good idea, but he recommended that we re-write the section on pets.  He said that there is no pet allowance, only a foreign transfer allowance.  He felt that the pet focus makes the Department look stupid and diverts the reader from the real issue - that EFM needs to be amended to include partners.  He said we should simply note "miscellaneous expenses" rather than a specific focus on pets. [Note: we took his concerns into consideration and re-worded our transition papers to read that the Department will reimburse for a variety of moving related expenses, including the transport of the family pet, but not the transport of a same-sex partner. We forwarded these changes to U/S Kennedy and have not yet received a response. However, a majority of the board felt it was important to leave the line in about pets, at least in this form, because it points out the extreme inequities our partners face.]
 
On other issues, GLIFAA requested a liaison with State's Legal Office (L) to serve as a neutral person to provide guidance on legal questions as they arise. U/S Kennedy said thought the idea was a good one and that he would work with L's Jim Thesson to identify a liaison to work with GLIFAA.  U/S Kennedy also took GLIFAA's suggestion of reissuing an ALDAC with the Berlin and Manila policies and heard GLIFAA's idea of advertising TDYs and funding TDYs - Creating Change, Out and Equal, UCLA Leadership Institute.
 
Following the meeting, we spoke with M's special assistant Kerry O'Connor, who concurred that a follow up meeting in mid-December would be a good idea.  We plan to follow up with DG Thomas in December as well, as part of GLIFAA's quarterly meetings with the DG.

We've also continued full steam ahead with very key, substantive organizational issues as the current board is committed to institutional history and legacy.  Our Intern, Joshua Jones, not only has been doing a terrific job in organizing outreach events like the AIDS Walk and our Holiday Party, but he has been steadily archiving all of our documents.  Please send any key GLIFAA documents you have, since our inception in 1992 (or earlier) to Joshua Jones.  The Policy Director and Treasurer have also been working with the law firm Sidley to see how GLIFAA could become a tax exempt organization and what that status may entail in terms of our future level of effort.  The entire board has also redrafted GLIFAA's by-laws and has submitted them to Sidley for their review as we consider incorporating as a tax exempt organization.

Policy Director Meets with Nepal LGBT Official

GLIFAA Policy Director included an LGBT outreach visit as part of his recent official TDY to Nepal.  He met with Sunil Pant, the first openly gay member of the Nepali Parliament.  He was briefed on work of the Blue Diamond Society including their recent success in ensuring that the Nepali Supreme court ruled favorably on the need for establishing a committee to look at the possibility of same sex marriage and a constitution that is inclusive sexual orientation and gender identity.  Mr. Pant followed up with a meeting at USAID where he had the chance to meet with the Office of Democracy and Governance and the Office for South and Central Asia, during his recent visit to the US.  Pant was in the US for 24th International Gay & Lesbian Leadership Conference where he delivered the keynote address entitled "LGBT Issues in Global Human Rights: Can the U. S. Help?"

Interested in Authoring that "Inside the Embassy" Article??

NEW! GLIFAA Legal and Visa Issues Working Group

The Legal and Visa Issues working group had its first meeting on Wednesday, October 8.  In attendance were Fred Boll, former GLIFAA President Bob Gilchrist, and GLIFAA Policy Director Ajit Joshi.  Fred Boll will be the Chair of the Legal and Visa Issues Working Group.  As Chair, Fred is looking for GLIFAA members who have a legal or policy background and are interested in preparing a legal analysis of practical issues confronting GLIFAA members to present to the Department.  A legal analysis will include canvassing various stakeholders such as the State Department's Office of Foreign Missions (OFM) that is charged with implementing bilateral agreements.  It will include, but is not limited to (1) Foreign Diplomats Obtaining U.S. visas for their partners, (2) FSOs obtaining non-U.S. visas and residence permits for partners, (3) the need for developing a Visa Template to send to post requesting that an MOH is so declared, and (4) the need for a Visa Template to send to DHS requesting that MOH is so recognized.

Meeting Notes/Plans:

  • The Legal and Visa Issues working group recommends that GLIFAA meet with GLIFAA's Executive Sponsor or Diversity Mentor, Undersecretary Patrick Kennedy to discuss the following key issues facing our membership: (1) Members of Household, (2) Domestic Partner Benefits and Obligations Act that would apply to FSOs and Civil Service Officers, (3) Areas where the foreign affairs agencies fall short on reaching a 100% score on the HRC Corporate Equality Index that might be new to the Undersecretary, such as Transgender Wellness Benefits (4) Need for an updated non-discrimination statement for contracts, grants, and cooperative agreements that includes sexual orientation and gender identity, (5) Retiree issues, (6) Need for EEO/Diversity Training to robustly include a focus on gender identity and gender expression.
  • The group wants to meet with the A/S for DRL David Kramer to recommend that on Human Rights Day in December that a statement be issued to explicitly state that sexual orientation and gender identity/expression are areas that the Department is focusing upon.
  • During the far ranging discussion, Bob Gilchrist shared how former A/S for DRL Harold Koh, an ally, was the reason for a greater focus and emphasis on sexual orientation and gender identity/expression in the State Department human rights reports.  
  • The group plans to have other meetings to triangulate the various concerns - consular issues (Dean Haas) to discuss reciprocity, AFSA's legal team (Zlatana Badrich), and to find someone that knows the laws and policies on EFM - is it a legal term (or not).  
  • As a separate project, Bob and Fred also promised to develop a GLIFAA monthly calendar for November 2007 through July 2008 that would include a regular meeting.  The calendar would also include an alternating happy hour and dinner.
  • Since the meeting the Policy Director has asked DG to identify someone in L to be GLIFAA's point of contact.  GLIFAA has also outreached to the General Counsel of HRC to find a pro-bono lawyer to help GLIFAA to see if GLIFAA could obtain 501C3 status
  • The group also thought it would be a good idea to publish an article in the Foreign Service Journal.
USAID Of Note!
Check out the following links to address concerns at USAID

First, the Executive Diversity Council seeks input for 2009.  Do read the USAID general notice and write to USAID's Jim Vandenbos and Lisa Chiles to ensure the Agency's diversity agenda is LGBT inclusive. 

Second, to parallel the effort at State, there is now an AFSA survey for USAID staff.  All USAID Foreign Service Officers are requested to complete AFSA's third annual member survey.  It is an opportunity to ensure that LGBT concerns are heard.  The survey will close to submissions on January 1, 2009. The results will be published in the Foreign Service Journal and the Vanguard newsletter in early 2009. 

Third is the USAID Administrator's Survey there are plenty of opportunities to raise MOH issues and LGBT issues.  The survey will not only be used by Administrator Fore and USAID senior leadership to measure progress made in the past year, but will also inform the views of the incoming team and help shape how services might be improved going forward.  In order to ensure maximum participation, the deadline for the Administrator's survey is now Friday, December 19, 2008.  All employees, including Foreign Service Nationals, Foreign Service Limited, Personal Services Contractors, and others, are strongly encouraged to complete the survey. A New Global Network:  Be a GLIFAA Post Representative
FSOs as well as MOHs Welcome to Participate!

"Hi, I'm being transferred to Kerblekistan - are there any GLIFAA members there who could give me info about post?"

We know our members are everywhere, but for too long we haven't had a way to effectively get information from the field.  Our new network of GLIFAA Post Representatives will fill that void.  Even if you are the only GLIFAA member at post, we hope you'll volunteer.  You'll be called upon everytime we get an email asking for info at post, you'll join a special listserve for Post Reps worldwide to share best practices, and you'll serve as a channel for communication to and from Washington.

The basic time commitment will be extremely minimal (~1 hour/month) but those interested in doing more certainly can.  Help your post's Human Rights person learn more about conditions for LGBT persons in your country of assignment, network with Human Rights advocacy groups stateside or in your country of assignment, help us with our advocacy work in Washington - whatever interests you.

Make our network truly global - make sure your post volunteers a representative.
 
GLIFAA's Advocacy Campaign Wants Your Story Heard!

We're gearing up for a big year - a new President will be coming in, a new Secretary - and a new Congress!  The time to prepare is now.  GLIFAA is drafting a series of advocacy materials on issues that affect our members, and nothing is more powerful than a first-hand story.  How are you being hurt by the Department's policies?  How is your family being hurt by the Defense of Marriage Act?  Please write your stories (between 1 paragraph and 1 page) and send them to glifaa@yahoo.com.  We'll use them as best we can to get our message across.  To get you inspired, here are two stories from other members:

"I was in the Army and served in Operation Iraqi Freedom until March 2005.  I joined the Foreign Service in October 2005, and soon after shipped out to India with my partner Ales.  I'm due to return to Washington for eight months of language training, and the cost of plane tickets aside, I'm worried that Ales won't even be allowed to enter the country for the full eight months, because he can only qualify for an ordinary tourist visa.  All I ask is for us to enter my country together - the same country I fought for in Iraq and the same country I still love and serve today."

"When my partner landed in Chicago, Immigration grilled him for two hours.  They accused him of being illegal, overstaying, you name it.  They found my business card in his luggage and demanded an explanation - as if it was inappropriate for him to have it.  He patiently explained the situation numerous times, and was eventually released - but with permission to stay for only three months.  Incidentally, two of my colleagues from Sao Paulo met their [opposite-sex] spouses after JP and I met.  They both are now U.S. citizens traveling on Diplomatic passports."

The MOH Network has been having a lively discussion on Yahoo-Groups and the Board encorages MOHs to participate!  Email moderator Emil.Stalis@tufts.edu if you cannot access the homepage of the network   Please provide identifying information (employee of which organization, or MOH of which employee who is at which organization) so that you can be verified prior to being part of the group.

Michelle Schohn is looking to create links from her blog to any of the blogs of other FSOs and/or MOHs, in particular who have stories about MOH issues.  If you have a blog and are willing to let Michelle put a link to your blog on her blog, please email her. 

And if you're still not convinced, Michelle, a Public Diplomacy professional, says "I think blogs are a good way to let people know what life is like in the FS, whether as an employee, spouse/partner (same or opposite sex) or family member. And for those of us with MOH or partner issues, it is an excellent way to get the word out on what we deal with!"
 
"The MOH Network" is a discussion group for all individuals who fall into the classification of Members of Household as defined in 3 FAM 4180 and their partners/sponsors.  A MOH is anyone accompanying a Foreign Service Officer to post.  This includes parents, partners, (opposite sex, same sex), and children over age 21.  In other words-anyone who is not mentioned on an officer's orders.  The MOH Network is a venue for MOHs to seek out resources and information.  It is also a place for individuals to share strategies, vent frustration and most important - find support.

Employees are requested to please share this information with their family members.
