Welcome to your September edition of the Charity Law Insights. 
 
The advent of fall is always a time of new beginnings and so it is in the charity world as well. In the coming months, we expect to see the enforcement of the new Federal corporate law for Not for Profits (and perhaps a provincial one in Ontario as well). At Drache Aptowitzer PC we are also happy to announce a new beginning as we welcome Joel Secter to our firm. Joel not only has a particular interest in the charity world but he has a distinguished background in the arts world. In the coming months Adam Aptowitzer will be conducting a series of webinars and speaking at the Winnipeg conference of the Canadian Council of Christian Charities, the National meeting of the Canadian Friends of the Weizmann Institute, and the National Synod of the Anglican Network in Canada. He hopes to meet some of his readers there.
 
Finally, September also brings with it the Jewish holidays. DAPC wishes all of its Jewish readers and clients all of the best in the new year.

We often receive calls from members of the public who have had some concern about a particular charity of which they have some association.  At times they ask what they can do to hold the charity accountable for any of its alleged misdeeds. While the barrier to taking action can often be financial (and quite high at that) in Ontario the courts have recently ruled that anyone can hold a charity accountable.

Fighting It Out - New Forums in the Canada Not for Profit Corporations Act

The new Canada Not-for-Profit Corporations Act includes two remedies for members of the corporation to pursue when they feel that either the interests of the corporation or their interests as members are not being represented. This is necessary because members are not typically involved in the day to day business operations of the corporation.
