IHSS Requirements Repealed by SB 930

On October 9th, Governor Brown signed SB 930 (Evans) into law, repealing three controversial requirements enacted as part of former Governor Schwarzenegger's IHSS anti-fraud measures in 2009. The first provision would have required all IHSS consumers to submit fingerprints to the county at the time of their assessment/reassessment, for identification purposes. After many delays, this provision of the anti-fraud measures was not enacted, and it was estimated that doing so would have cost the state over $40 million.  

 

SB 930 also repeals legislation that would have required both consumers and providers to place an index fingerprint on each IHSS timesheet (also never implemented), and prohibited IHSS providers from receiving paychecks at a PO box address. Since the enactment of these measures, advocates and certain state legislators have claimed that there is no evidence indicating that either of the measures would have actually prevented instances of fraud.

In Memoriam: Sandy Varga

Sandy VargaSandy Varga, a member of the PASC Governing Board and recently elected Board Chair, unexpectedly passed away on Friday, September 23rd.

 

Born in New York, Sandy moved to the Los Angeles area in 1984 and began a finance career in the entertainment industry. In 2002, she was diagnosed with cancer and two years later became hemiplegic due to a medication error. She eventually went into remission and was declared cancer free, but spent the rest of her life living with a disability.

 

Sandy viewed her new life as a blessing and followed her second calling as an advocate for the disability community. In 2008, she was appointed to serve on the PASC Governing Board. She was also appointed to serve on the Access Paratransit Services Board of Directors, and served as the Southern Region Vice President of the California In-Home Supportive Services Consumer Alliance (CICA). Sandy volunteered her time by representing IHSS consumers on the statewide IHSS Coalition and was later appointed Coalition Chair. She also made countless trips to Sacramento to testify at public hearings, visit with legislators, and participate in various rallies related to disability issues.

 

Sandy's efforts as an advocate for the IHSS and disability communities were recognized in 2008, when she was the recipient of an L.A. County Access Award. Her dedication to empowering people with disabilities and her presence among the IHSS community will be missed.

 

Sandy is survived by two children and four grandchildren.

Do You Know Someone Who Might Be a Hoarder?

Hoarding is defined as the excessive collection and retention of objects or animals to the extent that they interfere with a person's health, ability to function in their home, or their family, work and social life. Hoarding is often considered to be a symptom of a mental illness such as an anxiety disorder or obsessive compulsive-disorderA hoarder is not simply a pack rat. A pack rat gets rid of some "collectibles" when he or she runs out of room in the garage or basement. A hoarder simply moves the stuff into the bathtub. 

 

Reasons why some people hoard include:

  • Items are perceived as valuable
  • Belief that items provide a sense of security
  • Fear of forgetting or losing items
  • Constant need to collect and keep things 
  • Obtaining love not found from people
  • Fear others will obtain their personal information
  • Physical limitations and frailty
  • Inability to organize
  • Self-neglect
  • Stressful life events    

Severe hoarding causes safety and health issues such as fire hazards and the potential to spread contagious diseases. If you know someone who is hoarding, a collaborative intervention involving the person, their family, and other agencies (i.e., mental health, animal control) may help. Careful assessment of the individual situation is essential for a successful outcome.  Interventions without the person's cooperation can lead to the development of dangerous behaviors. If you believe that the person's hoarding behavior is putting them in danger, you may also wish to contact Adult Protective Services at 877-477-3646.

Legislation Watch
Several bills that could have an impact on the IHSS community have been introduced in the senate and assembly for the 2011-2012 legislative session. Listed below are the bills that PASC is currently tracking. For additional information on any of the bills, visit PASC's website at www.pascla.org.

  • AB 40 (Yamada) - Elder Abuse Reporting: Passed by the assembly on May 23rd. Did not make it out of committee in the senate before deadline.
  • AB 138 (Beall) - Elder Economic Planning Act of 2011: Signed into law by Governor Brown on October 9th.
  • AB 622 (Dickinson) - Civil Grand Juries: Signed into law by Governor Brown on October 9th.
  • AB 876 (Valadao) - Hiring IHSS Providers: Signed into law by Governor Brown on July 7th.
  • AB 889 (Ammiano) - Domestic Work Employees: Passed by the assembly on June 2nd. Did not make it out of committee in the senate before deadline.
  • SB 393 (Hernandez) - Patient-Centered Medical Home Act of 2011: Passed by the senate on June 2nd. Did not make it out of committee in the assembly before deadline.

  • SB 411 (Price) - Home Care Services Act of 2011: Was not voted on by the assembly before the deadline for bills to be sent to the governor.

  • SB 930 (Evans) - IHSS Enrollment and Fingerprinting Requirements: Signed into law by Governor Brown on October 9th.
