The Tuckers, of Quitman, Arkansas, made history when they filed the first class action lawsuit in response to fracking [Tucker v. Southwestern Energy Company, XTO Energy, Chesapeake Energy Corporation and BHP Billiton Petroleum (Fayetteville), LLC, No. 1:11 CV 44 DPMfiled on May 17, 2011 in U.S. District court for the Eastern District of Arkansas.
What exactly is fracking, and why is it an issue of contention? "Fracking" is a commonly used term for hydraulic fracturing, a process of injecting water, sand, and a cocktail of chemicals at high pressure into rock formations thousands of feet below the surface. The practice promotes a freer flow of natural gas and oil from the rock into the wellbore.
Opponents of fracking cite environmental and human health concerns associated with the practice, including earthquakes, the contamination of ground water, risks to air quality, the migration of gases and hydraulic fracturing chemicals to the surface, and the potential mishandling of waste. These concerns are warranted, as fracking has already been linked to drinking water contamination and property damage in Colorado, Ohio, Pennsylvania, Wyoming and other states.

 | Save Time, Use a Licensed Investigator in Your Class Action Suit | |
Anderson v. Pacific Gas and Electric is one class action suit that Pacific Gas & Electric (PG&E) executives are destined to remember for a very long time. The suit, which gained fame in the movie Erin Brockovich, involved residents of Hinkley, California who sued PG&E claiming that PG&E officials were aware that the chemical called hexavalent chromium (or chromium 6), a by-product of PG&E operations which was being dumped into unlined ponds, was potentially carcinogenic and may leak into surrounding groundwater supplies.
Hexavalent chromium did, in fact, prove to be carcinogenic, and hundreds of men, women, and children in the area were diagnosed with cancer and other related conditions as a result of using contaminated water that PG&E led them to believe was safe. The 600 plaintiffs in the suit were successful in recovering $333 million from PG&E, and subsequent suits have been filed.
