Know the Credibility of the Business Before Investing

This is the story of a prominent southern law firm that represented an out-of-town client. The client was considering investing in a business in another state. However, they had concerns about the validity of the business venture and the sources of the capital contributions by the other principals. What would you do in that situation? Chances are you would at least conduct rudimentary research to verify basic information about the business. Would that be enough to satisfy you? Should it be?

What Are the Prospective New Investor's Intentions

An individual was recently exploring the possibility of an investment partnership. We were asked to research the background, financial wherewithal and character that had been presented to our client. The information the existing party provided about himself indicated specific strengths that would be mutually beneficial, and his resume indicated he had a degree from a prestigious west coast college as well as a host of memberships and appointments in professional associations. With an office in Europe and international connections in related industries, he seemed particularly well-suited for a partnership that aligned with our client's long-term goals. Although the individual's credentials were impressive, our client asked us to research the business and practices of this other individual "just to be sure." He seemed like a good fit, but was he really?

Not by a long shot.

Arkansas Investigations conducted a comprehensive, detailed investigation and found that the most this individual had to offer our client was a whole lot of nothing! The school he claimed to have earned his degree from had no record of him ever attending or even applying to the institution. Our inquiries into his professional memberships were met with a chorus of "We don't have a profile on him, which means he has never signed up for membership," "He was never a member," and "Who? I've never heard of him."
