NLRB POSTING REQUIREMENTS  

POSTPONED UNTIL 2012

 

On October 5, 2011, the National Labor Relations Board (the "Board") postponed the mandatory effective date of its newly implemented posting requirements from November 14, 2011 to January 31, 2012.  See NFC E-Alert NLRB Issues Deadline for Employers to Post Employee Rights Under the NLRB 9.15.11.  


The NLRB indicated that the postponement is in response to "queries from businesses and trade organizations," and was instituted for the purposes of "enhancing education and outreach to employers." The postponement comes, however, in the wake of a consolidated lawsuit filed by the National Association of Manufacturers and the National Federation of Independent Business. The suit challenges the validity of the rule on its face, alleging that the Board exceeded the scope of its authority in issuing the posting mandate. As a result, employers will have an additional two and one half months, at a minimum, to comply with the new posting requirements.
