Defending Possession of Child Pornography

Someone, sometime, told you about the facts of life. And someone, sometime was mistaken if they told you that possession of child pornography was not defensible. It is, in fact, very defensible when the following tactics are engaged. Each of these tactics will become clear as we discuss strategies and the action plan for your defense. And I apologize if you were looking for an article written as a story...this ain't it. This information is bullet-pointed, tight, to the point, and gives you the information you need. No fluff.  

 

Search and Seizure:

 

Start at the beginning to challenge the evidence!  

  • Was the search warrant valid; was there sufficient probable cause; was the affiant correct?
  • Did the search warrant Return match the conditions of the warrant?
  • Is the forensic computer examination process industry-standard, sufficient, accurate, and compliant with all laws and regulations?
  • Is the examiner correctly licensed, or is the law enforcement ("LE") agency using non-sworn examiners who are out of compliance with your state's laws governing private investigators?
  • Is the inventory correct and does the paperwork correctly coincide with the actual evidence?

Common Terms Used in Computer Forensics

We know that it is important for you to understand the jargon used by all forensic computer examiners so you can build the best possible defense for your client. We have provided you a list of many of the common terms used.  

 

Allocated space - those clusters (that space) on an HDD that contains data;

 

Bit-stream image - refers to every byte on an HDD, first byte to last;

 

.case file - the EnCase data, similar to work product...the extension given to the file containing the data is a ".case" file, similar to a ".doc" file for documents;

 

CATCH team - law enforcement high-tech crime unit: Computer and Technology Crime Hi-Tech Response Team;

 

Cluster - an allocated unit of space on an HDD, composed of multiple Sectors, and is the smallest unit of space upon which data can be written and/or saved;

 

Copy of HDD - I don't know what this is...nobody does; a copy can mean a number of different things, as can the term mirror-the correct term is image (see below);
