                        MARCELLUS SHALE DRILLING:
                   TWO STATES AND TWO STORIES
Several years ago, the first shale fracturing injection well was drilled in Western Pennsylvania. Since then, Pennsylvania has experienced a drilling stampede the likes of which has not been seen in decades. The drilling for shale gas has now become dominated by a few large players, few with any local roots in Pennsylvania or its rural communities. The risks to the drinking supply are well known, but the drilling goes on because the sale of gas puts money in local people's pockets, and is making a number of large players even wealthier than they already are. In the meantime, the State of New York has put a moratorium on drilling using the hydro-fracturing technique, until its safety is fully evaluated. In response to all this, the U.S. Army Corps of Engineers has taken a hands-off approach, declining to vote for a moratorium in the Delaware Watershed shared by New York and Pennsylvania.  
The New York moratorium was the result of intense lobbying by a grass-roots organization, the Citizen's Campaign for the Environment that argued for a ban based on the experience in Pennsylvania, highlighted in the documentary "Gasland" which, among other scenes, showed tap water on fire. What kind of regulation will be put in place in New York, and whether drilling will ever proceed in that state will be seen in May, 2011. In the meantime, drilling grows apace in Pennsylvania, as prices of mineral leases rise and gas extraction becomes an established part of the state's economy. Time will tell which approach will prevail and who will have the fewest regrets. In the next issue, we will discuss how this situation will play out in the marketplace. 
                     BP Update: Following the Money
As could be predicted, with the Deepwater Horizon well completely shut down and a chorus of experts happily proclaiming that deep sea bacteria have been hungrily working overtime to clean up all the oil spewed into the Gulf of Mexico in almost no time at all, it is back to business as usual for BP. While it raises $3.5 Billion with a long-term bond offering, and is looking at opportunities in Russia, it has begun talks with the U.S. Justice Department to settle the matter of the fines it will pay. Since all agree on how many barrels of oil escaped into the ocean from the broken well, the question is turning on whether BP was merely negligent, which carries a fine of $1,100 per barrel or grossly negligent, which carries a fine of $4,300. Those that did the math gave the spread as the difference between$5.3 Billion or $21.1 Billion. And, as could be predicted, before the money is even on the table, politicians from every Gulf Coast state are arguing over who gets to spend the money and where it will be spent.
