THRIFTY PROPANE'S DAY IN COURT Thrifty Propane's day in court was successful this past Friday: the Court seemed to bet on Thrifty Propane's right to free speech. The Court ruled it could not stop a lawsuit by the Ohio Attorney General since it could sue about any advertising that it claims is misleading but hinted that Thrifty Propane's right to free speech - the right to tell you and your neighbors about HD5 propane and the problems with "commercial grade" propane - will very likely prevail. But the Court kept the National Propane Gas Association (NPGA) in court: if Thrifty Propane's free speech prevails, if a court agrees that Thrifty advertising is right, that HD5 propane is the better fuel, as you already know, and rules against the Ohio Attorney General, which it should, then the NPGA will have to make Thrifty Propane whole for "putting the Ohio Attorney General up to this." Once that happens, the NPGA will have to tell the world why "commercial grade" propane is the same as HD5, and they know that no amount of spin can pull that off.
This court ruling is welcome, but not surprising, since it came from a court in Medina County, the same county whose Auditor coined the phrase "dump ground state" regarding unregulated gasoline. It is reassuring in these times to see those in public life that put the interests of the public they serve above politics. |
THE BP OIL SPILL UPDATE - FILL NOW TO INSURE YOUR SUPPLY
BP has pronounced its latest effort a success, with the new cap holding pressure over its ruined well. However seabed leaks near the well have now been reported. We all want this disaster concluded, but that may never come - we may be left with improvised half-measures until the Macondo oil fields are exhausted. Good science and common sense say if existing seafloor conditions are unaffected by the well, then a cap is appropriate. Good science and common sense also say that if the pressure created by the cap is damaging the seafloor, then the cap must be removed and the well turned into a producer, if only to relieve the pressure on an unstable geologic structure. Perhaps it is time for the government to look hard at BP's claims and be ready to resign itself to making this well a producing well, rather than risk more damage with heroic attempts to "kill" it. The charismatic leadership of BP cannot carry the day by charming exhausted Washington regulators, if the science does not support their position.
Because of this continuing uncertainty, there is no telling where propane prices will go, since this market reacts to the slightest event and the thinnest rumor. If news emerges that the cap of the well is just the beginning of story, prices may climb sharply as seabed oil drilling may have to be abandoned altogether.
