THE BP OIL SPILL UPDATE -
A SUMMER FILL INSURES SUPPLY AT A LOW PRICE
Market conditions for propane are changing all the time and we are constantly reviewing the market to get the best savings to pass on to you. BP's latest attempt to stem the Deepwater Horizon spill in the Gulf has not succeeded in keeping the heavy oil from choking off Louisiana's delicate wetlands. Meanwhile, the Justice Department has begun a criminal investigation into the spill, and the deliberate lack of preparedness driven by the demand to minimize expense. An additional detail is that the ship that held the "mud" used to seal the well was attached to the platform. When oil caught flame that burst out of the pipe at the top of the platform, those manning the ship pulled it away, and, in so doing, snapped the pipe at the bottom.
The oil market, however, has turned its focus to the weakening U.S. and European economies: with slower growth predicted, oil prices continue to drop. BP's position as a global supplier of oil nevertheless continues to deteriorate as it continues to battle a public liability disaster with no real success. Were BP's production and refining capacity to suffer as a result, prices once again could spike. There is still no telling whether the Houston Ship Channel, through which much of the crude oil gets delivered to the refineries, will remain passable. All of these uncertainties in the weeks to come will affect the price you pay for propane. THRIFTY PROPANE IN COURT -PROGRESS REPORT
Thrifty Propane, Inc. v. The National Propane Gas Association, Case No. 10-0806, Medina County Court of Common Pleas
Thrifty Propane was in court this past Friday with the National Propane Gas Association (NPGA) to test the difference between its pure HD5 propane and the "commercial grade" propane often offered by other propane companies. The NPGA represents the interests of the the oil and oil refining industry as well as the largest propane retailers. As we have told you in earlier newsletters, the NPGA has continuously maintained that there is no difference between pure HD5 propane, which contains no less than 90% chemical propane, and "commercial grade" propane, which is any mixture of gases that can hold a flame. When the NPGA announced that it would complain to the FTC concerning Thrifty's promotion of pure HD5 propane, we thought we could meet the challenge there. However, when the NPGA put Thrifty in the position where it had to admit that its advertising was deceptive when it was telling the truth about HD5 propane, Thrifty knew it had to act. So Thrifty took the NPGA to court. We remain confident that the court will see hat pure HD5 propane is the superior product, despite the fact that counsel for the NPGA stated that Thrifty has made "false statements" about HD5. We were astonished to hear this, especially when we have made these statements in reliance on the American Society for Testing and Materials and the strict standards of the line from which we pull our product. As to this writing, Thrifty Propane must face down the claims that black is white advanced by the most powerful forces in the energy industry. The next hearing is before Judge Collier on June 10, 2010, at 9:00 AM. The name of the case is Thrifty Propane, Inc. v. The National Propane Gas Association, Case No. 10-0806, Medina County Court of Common Pleas.

THE BROADER PICTURE - INTRODUCING CUSHING, OKLAHOMA America's hub of oil distribution is located in Cushing, Oklahoma, where traders on the New York Mercantile Exchange (NYMEX) hold the oil they trade and as the "settlement point" for West Texas Intermediate Crude (WTI), the benchmark price for crude oil in the United States. An enormous tank farm shared by BP, Enbridge, Plains All American, Enterprise Products, Semgroup, Conoco Phillips and Sunoco, Cushing, Okl., has emerged as this hub because of its central location to all the existing pipelines. Since 2000, the storage at Cushing has increased 50%, so that 75% of the oil processed in the United States passes through this transit and trading facility. With a capacity of 43 million barrels, it holds, at last estimate, 37 million barrels. This vast transit and trading facility becomes yet another point of control by big oil for the price of all petroleum related products. While almost any amount of oil can be pushed into the facility, only 50,000 barrels can leave the facility every day. Since 75% of the traded crude oil passes through Cushing, if prices are to be pushed down, they are pushed down at Cushing by creating a glut, by forcing the smaller traders to sell off to a member of big oil at a steep discount, who have their own capacity at Cushing. In effect, big oil can set lower the price of crude at Cushing at will. And they are increasing their storage capacity at Cushing all the time. The result has been that the benchmark price for crude oil has been shifted to BRENT crude, from the North Sea, rather an WTI, because big oil has made the U.S. price so volatile. Today, to offset the bad news coming from the BP spill disaster, big oil has lowered the price of WTI. Just as a few financial institutions determine the fate of our investments, so the few members of big oil can drive prices down at Cushing and with it, the price of crude, and, with it, the price of gasoline, heating oil, and propane. Because the price of United States HD5 propane is 30% lower than propane abroad as a result of this artificial glut, the real shortage will emerge when more and more of the United States' HD5 propane is sold abroad.
