Health Care Reform: Impacts on Consumer Driven Health Plans 
 
Health Savings Accounts  (HSA),
Health Reimbursement Arrangements (HRA) and Flexible Spending Accounts (FSA) 
 

The recently enacted health care reform legislation, Patient Protection and Affordable Care Act, PPACA, has specific impacts on health plan spending accounts that need to be communicated to employees. These impacts should be considered during open enrollment and throughout the balance of 2010.  The Alpha Group will work with clients to make certain employees are informed of these changes.
 
Over-the-Counter Eligibility for Reimbursement
For purchases beginning January 1, 2011, money from health plan spending accounts (HRA, HSA and FSA) will no longer be available to pay for most over-the-counter drugs and medicines without a doctor's prescription. We expect the Secretary of Health and Human Services to release details on both the type of documentation required, as well as the specific medications that will need documentation for reimbursement.

Penalty on HSA Distributions
Starting January 1, 2011, the tax penalty on HSA distributions that are not used for qualified expenses will increase from 10% to 20% of the disbursed amount.

Reimbursement for Expenses of Dependents
With the extension of dependent coverage to age 26, there are a few items to consider.  Money from HRA and FSA accounts may be used for eligible expenses incurred by all covered dependents. However, retroactive FSA reimbursement may be offered for expenses incurred by a child to age 26 - as far back as March 30, 2010. The IRS Ruling (2010-38) allows for this exception as long as the cafeteria plan documents are amended by December 31, 2010.

While the extension of dependents to age 26 impacts the underlying medical plan (HDHP), money from an HSA may only be used for eligible expenses incurred by covered dependents that meet the federal government's definition of a tax dependent.

If benefits are renewed off the calendar year (not on January 1), it's important that employees understand that the Over-the-Counter and HSA Penalty changes are effective on January 1, and are not tied to plan years or renewal dates.

Orlando has joined Alpha in the newly defined role of "Financial Technician."  Steve's duties & responsibilities will include working with clients on HSA, FSA, HRA plans; delving into health care reform as it relates to small business tax credits, affordability & excise tax penalty avoidance and Zywave Claims Reports.  He will also serve as resource support for brokers and account managers for consumer driven health plans.
 
Steve is a graduate of The University of Dayton with a Bachelors in Accounting. He is also currently a CPA candidate. Steve has most recently interned at Howard, Wershbale & Co. as an Auditing and Attestation/Healthcare Intern. He has also interned for the Federal Reserve Bank of Cleveland in Corporate Banking Organizations.

Stop Dieting
Start Being Healthy for Life
  
How many times have you decided to stop eating carbs, eat only cabbage soup, or never eat a potato chip again? Many of us have done it,  decided to take on an eating regime that we couldn't possibly sustain for the rest of our lives. Many of the diet plans work, for a while, until we decide we really want to eat a sandwich, really hate cabbage and can't live without a potato chip, at least once in a while! Stop dieting and start being healthy for life!

Diets will lead us down the road of unhealthy yo-yo weight loss and gain, but making healthy lifestyle changes will lead to long term weight loss and improved overall health.

Choose one eating habit to address and change it-work on only one at a time. Taking on too much can lead to feeling overwhelmed and the desire to quit. Addressing one issue at a time gives you time to make a permanent lifestyle change without feeling overwhelmed. Try adding a serving of   vegetables to one meal a day, replacing one soda for 8 ounces of water or having carrots with your lunch instead of potato chips. Continue with the new habit until it becomes just that, a habit, a way of life, a positive lifestyle change! Be proud of your self for making a positive change for health and then pick a new habit to address.
No need to change all at once.  Remember, change happens one small step at a time!

Enrollees in Health Reimbursement Arrangements Spend Less, GAO Finds

A study by the U.S. Government Accountability Office (GAO) finds evidence that health care spending by plan enrollees with health reimbursement arrangements (HRAs) generally increased by smaller amounts or decreased compared with spending by those in traditional health plans.
 
Consumer-directed health plans (CDHPs) combine a high-deductible health plan with a tax-advantaged account that enrollees can use to pay for health care expenses-typically either an HRA or a health savings account (HSA), as described in the box below.

Don't confuse the terms non-exempt and exempt with hourly and salaried.  Many clients mistakenly pay employees on a salaried basis in order to avoid the payment of overtime.  Under the Fair Labor Standards Act (FLSA), a non-exempt employee is entitled to receive overtime pay for hours worked in excess of 40 in a 7-day workweek and ALL employees are non-exempt UNLESS they specifically meet one or more of the FLSA "exemption" tests (Executive, Administrative, Computer, Professional or Creative Professional).
