New EEOC Guidance on Use of Arrest/Conviction Records; Supreme Court's "Ministerial Exception" to Title VII

 

The Equal Employment Opportunity Commission (EEOC) has just published updated guidance on the use of arrest and conviction records in making employment decisions. Both the guidance and a Q&A document are available on the EEOC's website, www.eeoc.gov.

           
 
Title VII - the federal anti-discrimination law,
does not prohibit an employer from requiring applicants or employees to provide information about arrests, convictions or incarceration. However, it is unlawful to discriminate in employment based on race, color, national origin, religion, or sex. The connection between the two is this: because certain racial and ethnic groups have higher arrest and conviction rates than whites, using such records to bar employment would have a disparate impact on members of the protected groups. 

  

 

The guidance recommends employer "best practices:" eliminate policies or practices that exclude people from employment based on criminal records; train managers, hiring officials and decision makers about Title VII; develop a narrowly tailored written policy and procedure for screening applicants and employees for criminal conduct; identify essential job requirements and the actual circumstances under which the jobs are performed; determine the specific offenses that may demonstrate unfitness for performing such jobs; identify the criminal offenses based on all available evidence; determine the duration of exclusions for criminal conduct; include an individualized assessment; record the justification for the policy and procedures; keep a record of consultants and research considered in crafting the policy; train managers, hiring officials and decision makers on how to implement the policy and procedures; when asking questions about criminal records, limit inquiries to records for which exclusion would be job related and consistent with business necessity; keep information confidential.

As I was reading the most recent NBOA Net Assets Magazine and came across the attached article by Mari Brown interviewing Janice Abraham, President and CEO of United Educators, I was struck by the relevance of this article to the work that MISBO is doing and each of you are doing at your schools. Business Officers join the independent school world with a variety of skills - most of you have had successful careers in the financial sector in some form or fashion. Few of us came into our roles as business officers with a strong background in risk management. We needed to learn this on the job. Janice had a similar career path prior to joining United Educators 25 years ago and she understands the challenges facing Business Officers today. In this article she takes the time to share with us her expertise. Please take some time to read the "20 Questions".
