Job Descriptions and the ADA

A member school asked
if there is any particular language that has to be inserted into a job description in order to make the job description compliant with the Americans With Disabilities Act.  For example, would you have to say in a job description:  Duties and responsibilities herein may be modified to make reasonable accommodations to persons with disabilities?

 

The answer is no.  There
is nothing in the ADA that requires job descriptions to be compliant with anything.

 

 What the ADA says is
this: a "qualified individual with a disability" must
be offered reasonable accommodations to perform the essential functions of his job.  If
in advance, the employer designates what the essential job functions
are, then the employer's designation will be taken as evidence that the designated functions are indeed essential.

 

So this is for the benefit
of the employer; the employer can either designate job functions
as essential or not; it
is entirely up to the employer; there's nothing in the ADA that requires any modification to job descriptions or the addition of any language.

 

 You probably couldn't literally designate all the functions of a job as "essential."  A court might be skeptical of that.  And, the designation can be by a simple asterisk.  For example:  Must be able to use a computer to grade exams.*

 

*Denotes essential job function.

 

That's all you need, if you even want to do that.

Irritable these days? Having difficulty focusing? Poor sleep? Unable to resist the 'comfort foods'?

 

Fallout from the current financial meltdown has taken its toll on our wallets, our job security, and our peace of mind. If this was not enough now there's a new survey of 300 married couples conducted by Professor Wayne Hockwarter at Florida State University's College of Business who has quantified just how stressed we are. Moreover, we are all in the same predicament.

 

Over 70 percent of those surveyed said that the recession has "significantly increased the stress levels of employees in recent months." Demands from management have increased, they say, including pressure to cut costs "on a weekly basis." Over 80 percent said that they were "nervous about their long-term financial well-being." Similar majorities have "significantly" cut their personal spending (more than 60%) and say it is unlikely they will retire when they had planned or with the nest egg they had anticipated having even a year ago.
