HUD Issues New FHA Federal Register Notice Clarifying Liquidity Requirements

On Friday, August 24, 2012 HUD issued a New FHA Federal Register Notice to clarify and make corrections to the Final rule previously issued on April 20, 2010 - Strengthening Risk Management Through Responsible FHA-Approved Lenders. This New FHA Federal Register Notice made clarifications to the Liquidity requirements. As of May 20, 2011 FHA approved non-small business lenders and mortgagees were required to have a minimum net worth of $1,000,000 and FHA approved small business lenders and mortgagees were required to have a minimum net worth of $500,000. This register clarifies that the liquidity requirement is 20% of the required minimum net worth.
The actual language is:
For non-small business, each approved lender shall have a required minimum net worth of not less than $1,000,000. No less than 20 percent of the approved lender or mortgagee's required minimum net worth must be liquid assets consisting of cash or its equivalent acceptable to the Secretary.
For small businesses, each approved lender or mortgagee that meets the size standard for its industry classification established by the Small Business Administration shall have a required minimum net worth of not less than $500,000. No less that 20% of the approved lender or mortgagee's required minimum net worth must be liquid assets consisting of cash or its equivalent acceptable to the Secretary.
In addition to the above clarification, this federal register also made clarification to the definition and use of Sponsored Third-Party Originator.
