HCBS Reductions? What Advocates Can Do.

State, Justice Department Reach Agreement on Mental Health Plan

Agreement avoids direct federal control, lays out measurable benchmarks

Governor Sonny Perdue today announced that the State of Georgia and the US Department of Justice (DOJ) have reached a settlement agreement that avoids direct federal control of the states services for people with developmental disabilities and mental illness and adds concrete goals to Georgias current plans to expand services in communities. Under the agreement, the state will stop admitting people whose primary diagnosis is a developmental disability into state hospitals by July 2011 and instead place them directly into community services. By July 2015 it will attempt to place any who remain in state hospitals into community services as well. The agreement also provides for expanded community-based services for approximately 9,000 individuals with mental illness. The new agreement lays aside a DOJ lawsuit brought earlier this year under the Americans with Disabilities Act.

We're happy that, after long and frequent negotiations, we now have an agreement with measurable goals that preserves Georgia's ability to make decisions on how best to serve Georgians, said Governor Perdue. I have always said the state needed to provide better services to our most vulnerable citizens, and the Department of Justice has played a helpful role in spurring change in Georgia. I am confident we finally have an agreement that moves us towards our common goals of recovery and independence for people with mental illness and developmental disabilities.

The new agreement is part of a series of actions that have sought to reform Georgia's behavioral health and developmental disability services. In its 1999 Olmstead decision, the US Supreme Court found that people with mental illness and developmental disabilities in Georgia and other states have a right to receive services in community settings instead of being segregated into state hospitals. The new settlement agreement furthers the State's commitment to comply with the Olmstead agreement, replacing and expanding upon an existing voluntary compliance agreement that was entered into in 2008. It reaffirms, and does not replace, a separate agreement that seeks to improve the safety and effectiveness of the state's psychiatric hospitals.

The staff members at our hospitals and regional offices have worked long and hard to make the people we serve safer, said Dr. Frank Shelp, Commissioner of the Georgia Department of Behavioral Health and Developmental Disabilities (DBHDD). This agreement would not have been possible without their dedication, and it's that commitment to the people we serve that will make it a success.

In 2009, Governor Perdue and the Georgia General Assembly created DBHDD to focus solely on policies and programs for people with mental illness, developmental disabilities, and substance use disorders. In its first year of operations, the agency improved the safety and effectiveness of the seven state hospitals, expanded community-based services, built innovative partnerships with several medical schools in Georgia, and forged strong alliances with Georgia advocacy and consumer groups.

 Vounteers needed
for Human Rights Council
To ensure the protection of health and human rights of persons with developmental disabilities, the Georgia Department of Behavioral Health and Developmental Disabilities (DBHDD) Division of Developmental Disabilities (DD) is calling for volunteers to participate in the Human Rights Council.

As authorized by DBHDD Policy #02-1101, the Human Rights Council is an advisory review body and determines rights violations. The Council reviews allegations of suspected individual rights violations, individual support plans related to individuals being prescribed five or more psychotropic drugs, and all requests for participation of individuals receiving DD services in experimental research to ensure adherence to the practices of DBHDD.

There are at least two council bodies in each of DBHDD's six regions with seven to nine people in each review body. Meetings are convened on a quarterly basis for each of these councils.

Membership is comprised of community volunteers who have qualifications in one of the following eight categories:

a) Medical Professional (one of the following required)

1. Physician
2. Registered Nurse

b) Pharmacist (required)
c) Self Advocate (required)
d) Parent and/or Guardian (required)
e) Law Professional/Enforcement (one of the following required)

1. Lawyer (relevant field to DD services)
2. Law Offices 3. Paralegal

f) Business Leader or Faith Community Leader
g) Educator active in the classroom and or administration

1. School Teacher (relevant field to DD services)
2. College Professor (relevant field to DD services)

h) Advocacy Professional

1. Paid ARC staff member
2. Paid DD advocacy organization staff member

September Revenues Up, But Long Road To Full Recovery

State revenues in September were up 5.7 percent over revenues in September 2009, according to data released by the Georgia Department of Revenue. That is certainly good news, but Georgia has a long road to recovery in revenues.

 

Net revenues in the first quarter (July-September) were 7.4 percent above first quarter 2009 revenues. However, fewer income tax refunds were issued in the first quarter of 2010 compared to 2009, giving 2010 a temporary boost in July and August. Removing the anomaly of fewer refunds, gross revenues grew by 1.9 percent in the first quarter. The revenue estimate for the fiscal year is currently set at 4.2 percent.

 

"Consider a worker who has his pay cut by 20 percent, and then receives a 5 percent raise. The pay raise is great news, but he is still going to have trouble paying his bills, much less saving for his kid's college education," said Alan Essig, executive director of the Georgia Budget and Policy Institute. "That's what the state faces today. Revenues are growing, but we have a long way to go to regain the ground we lost. The state will continue to struggle to pay for essential services or invest in infrastructure unless leaders reform and improve our tax structure."

Welcomes New Team Members

The new Project Director for MFP is Bill Daniels. Mr. Daniels, a registered nurse since 1986, and a licensed nursing home administrator since 1990 joined the Department of Community Health on October 18, 2010. His nursing practice has included Intensive/Coronary Care, Open Heart/Heart Transplant Recovery, Corrections (jails, prisons), DBHDD (adults, adolescents, forensics), and Skilled Nursing Facilities. Recently Mr. Daniels served as the administrator of Georgia Regional Hospital Atlanta's Skilled Nursing Facility and the ICF/MR.  The past 20 plus years of his career has been in Long Term Care. He has a wealth of experience in long term care, including an in-depth understanding of the nursing facility side of the equation, which will be tremendously valuable to continuing our mission with MFP.

 

Secondly, Cedric Starks has joined the team in the newly created MFP Housing Specialist position. Mr. Starks joined DCH on October 1, 2010. He holds a bachelor's degree in Political Science with a pre-law concentration from Morehouse College in Atlanta, GA. Prior to coming to DCH, Mr. Starks held the position of HAP Contract Administrator with the Atlanta Housing Authority and a position as a Disability Adjudicator with the Georgia Department of Labor.  Mr. Starks is also a licensed REALTOR in the state of Georgia. His extensive experience in the housing arena will help us move forward with a deeper engagement of the housing community throughout the state, and therefore closer to our goal of increasing and expanding housing resources for the individuals we serve.

Governor Purdue Announces September Revenue Figures 
 
Governor Sonny Perdue announced that the net revenue collections for the month of September 2010 (FY11) totaled $1,449,825,000 compared to $1,371,956,000 for September 2009 (FY10), an increase of $77,869,000 or 5.7 percent.

The percentage increase for FY11 compared to FY10 is 7.4 percent.
