What is Elder Mediation?
Elder mediation, like elder law, is defined by the client to be served. Elder mediation is  mediation of any conflict that involves elders, their family members or others in their lives. The first contact with the mediator does not necessarily have to come from the elder involved.
Neither the legal profession nor the public at large has as yet fully recognized the value of elder mediation. A Portland elder law attorney shared his perspective with me that elder mediation is today at the stage of development where elder law was fifteen years ago and private geriatric care management was twenty years ago.

Second Circuit Won't Allow Non-Signatory to Invoke Arbitration Agreement in Antitrust Lawsuit Against Credit Card Issuers
The Second Circuit Court of Appeals has held that a "complete stranger" to an  arbitration agreement, with no contractual relationship to either the signatories or the obligations under the contract, cannot enforce the arbitration agreement under the doctrine of equitable estoppel. In Ross v. American Express Co., Nos. 06-4598-cv(L), 06-4759-cv(XAP), 2008 WL 4630314 (2d Cir. Oct. 21, 2008), Ross filed a putative class action lawsuit alleging that American Express (Amex) and other credit card issuers participated in a conspiracy to fix certain fees charged to cardholders.
