Ask Lynn / What Would Lynn Do?

This is a real situation. The multiple choice answers are shown to let you come up with the solution. The actual answer is below in red.


Experience and expertise can often lead to solutions that are not apparent to the uninitiated. This question springs from a presentation I did recently entitled "What Would Lynn Do?".


Q: I work for ABC Company and I just found out my daughter wasn't added on to the plan when she was born in March and it turns out they don't have to because I didn't report her birth on a timely basis. My employer has been deducting for her but the carrier is not covering her. What happened and what can I do?

  • Immediately cover her through MediCal or Healthy Families.
  • Threaten to sue the company if they don't add her immediately.
  • Self insure the child. How much can a baby cost? Open enrollment is only 10 months away.
  • Ask the employer to change insurance companies as the baby would have to be covered with the change in plans.
  • None of the above.

The employer and employee thought, because the premium was so high, that it must have included the child. Unfortunately, it was only an employee and spouse rate. Lynn explained the confusion and asked the carrier for an exception, and they agreed. Sometimes asking the right question is all it takes.

Doctor Earth Stethoscope IMageThere are a lot of things to discuss in the Health Care Reform Law regarding guaranteed coverage for children with no pre-existing conditions.


Case in point:

"The prohibition on pre-existing condition exclusions, which also prohibits denial of health care coverage due to a pre-existing condition, begins January 2014. However, health plans must implement this provision for children under the age of 19, beginning with plan years or policy years beginning on or after September 23, 2010."


This really only comes into play for individual plans as group plans cannot turn people down and can only impose limited pre-existing conditions if there is no prior coverage. In reality, most carriers have stopped selling to children and to families with children under 19 for the time being. This is because rates have been backed up at the Department of Insurance and have not yet been approved. There is also confusion about the provisions, so they are waiting until January to comply. At this point, Blue Shield and Kaiser will cover children, but not automatically, and they can be turned down.
