Greetings!

plm HEADSHOTWelcome to my newsletter for clients and anyone else interested in intellectual property (IP) and negotiation skills.  Please let me know if there is a topic or question you would like me to talk about, including the result of last week's Bilski case in the Supreme Court.  Write to chessboard[at] NegotiationPro.com.  And thank you for reading on.

The content of this newsletter and linked destinations are not legal advice but general information--in specific situations please seek legal advice from an experienced attorney.

How do I copyright the title of my book?
You cannot, but you can protect it.

While you can protect your book or even an article by copyright, a short phrase or sentence like a title cannot be protected by copyrighting it.  A trademark will do what you want, but it also has down sides.

Listen Carefully While Negotiating
You may hear what your counterpart would consider a good  deal you can also agree to.
Horse logo no nameSome people negotiate by incessantly demanding what they want from the deal, while the other side just sits there thinking "No way." There is a better way to get to a deal.  Click here for my Articles web page, and then click on "Make the Deal Sustainable."

It's just an ad, how can it be a contract?
"If you use our flu remedy and still get the flu we will pay you £100."

The drug maker wanted to pump up sales.  So they advertised in the newspaper that if you use their nasal product--also good for embalming-- for two weeks, and still got the flu, the company would pay you 100 pounds, a lot of money in 1892.  Mrs. Carlill followed the printed directions, but still got the flu.  Sadly for the company, which wished to ignore the whole thing, Mr. Carlill was a lawyer and sued, in the singular case of Carlill v. Carbolic Smoke Ball Co.  Read more: Click here for my Articles web page, and then click on "It's Just An Ad?"

"Don't get an attorney involved--lawyers are deal breakers."
Meeting of 3 people
Yes, sometimes your lawyer will break a deal taht should be broken, as bad as it is for you.  A good lawyer, like the Negotiation Pro, will use creativity to make the deal happen.
